O-93-63JKS93ORDS2A211223/57 ORDINANCE NO. 0 -93 -63 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - DRIVE -IN BANK FACILITY Published in pamphlet form this 20th day of December , 1993 by the President and Board of Trustees of Deerfield ORDINANCE NO. 0 -93 -63 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - DRIVE -IN BANK FACILITY WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Deerfield Federal Savings and Loan (herein referred to as "Applicant ") for approval of an amendment to an ordinance previously granting a Special Use for a Drive -In Bank Facility on the premises legally described in Exhibit A attached hereto and made a part hereof (the "Subject Property ") to permit a drive -up Automatic Teller Machine under and pursuant to the provisions of Articles 5.01 - C,2,b(2), 13.04 -B,2 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact and recommended that the Amendment to Special Use as proposed be approved and authorized subject to certain conditions and restrictions hereinafter set forth; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the approval of the Amendment to Special Use in accordance with the testimony and documentary evidence presented by Applicant to the Corporate Authorities in the Site Plan proposed by ATMI Structures dated August 13, 1993 and attached hereto as Exhibit B. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby ONE: affirmatively find that the Amendment to Special Use as proposed by Applicant fully complies with the requirements and standards set forth in Article 13.11 -D of the Zoning Ordinance of the Village of Deerfield and the Amendment to Special Use of the real estate, as and for purposes of a Drive -In Bank Facility as proposed by Applicant including an Automatic Teller Machine be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. ORDINANCE NO. 0 -93 -63 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - DRIVE -IN BANK FACILITY SECTION That the approval and authorization of said TWO: Amendment to Special Use hereby granted is subject to the following conditions: (A) That all use, construction and development shall be in accordance with the Site Plan prepared by ATMI Structures dated August 13, 1993 and marked Exhibit B, attached hereto and made a part hereof, all other documentary and exhibit filings made pursuant to the Special Use provisions of the Village Zoning Ordinance, the terms of this Ordinance and all representations by the Applicant to the Plan Commission and President and Board of Trustees. (B) That the architectural facade presented by the Applicant to the Board of Trustees be included as part of the Automatic Teller Machine improvement. (C) That Applicant comply with all other applicable Codes and Ordinances of the Village of Deerfield. SECTION That any violation of the conditions THREE: hereinabove set forth or cessation of use in accordance with the evidence adduced before the Plan Commission and the Corporate Authorities shall result in the revocation of the Amendment to Special Use hereby authorized. SECTION That the approval and authorization of said FOUR: Amendment to Special Use hereby given is subject to the requirement that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That the Village Clerk is hereby directed to FIVE: publish this Ordinance in pamphlet form.
