O-93-57ORDINANCE NO. 0 -93 -57 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 634 ORCHARD AVENUE, DEERFIELD, ILLINOIS WHEREAS, GEORGE and SUZANNE KLAUKE have petitioned for a variation from the strict provisions of Articles 4.03- F,3,f(2) and 2.03 -D,2 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, to property legally described below which would permit the construction of a new garage to within 2 feet of the side and rear property lines in lieu of the minimum 5 feet, with a footprint occupying more than 30% of the required rear yard; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of ONE: the Zoning Board of Appeals are concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That the Board of Trustees finds that there are TWO: practical difficulties and particular hardships the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield applied to Petitioners' property, which is legally described as follows: Lot 1 in Owner's Homestead Subdivision in the South West Quarter of Section 28, Township 43 North, Range 12, East of the Third Principal Meridian, according to the plat thereof recorded December 11, 1922, as Document 218864, in Book "L" of Plats, page 48, in Lake County, Illinois. in as ORDINANCE NO. 0 -93 -57 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 634 ORCHARD AVENUE, DEERFIELD, ILLINOIS SECTION That a variation from the strict provisions of THREE: Articles 4.03- F,3,f(2) and 2.03 -D,2 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described, is hereby granted so as to permit the construction of a new garage to within 2 feet of the side and rear property lines in lieu of the minimum 5 feet, with a footprint occupying more than 30% of the required rear yard. SECTION That the variation hereby granted is subject to FOUR: compliance by the Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and FIVE: effect from and after its passage and approval, as provided by law.
