ORDINANCE NO. 0 -93 -53 AN ORDINANCE AMENDING PORTIONS OF ARTICLE 12 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Corporate Authorities of the Village of Deerfield (the "Applicant ") to consider certain text amendments to the Zoning Ordinance of the Village of Deerfield relative to the adoption of a Development Code to govern Planned Unit Developments; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact and recommended certain text amendments to the Zoning Ordinance of the Village of Deerfield to achieve the objective sought by the Applicant; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the recommendations of the Plan Commission will serve the best interests of the Village of Deerfield. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Article 12.00 -B of the Zoning'Ordinance ONE: of the Village of Deerfield, as amended, be and the same is further amended by adding a new Article 12.00 -8,5 as follows: "5. Assurances To assure the Village, and future occupants and future owners of Planned Unit Developments that the amenities, circulation systems, utilities, and other components of the approved plan including those usually provided as public improvements will be established in accordance with the approved final development plan and with other requirements placed on the Planned Unit Development." SECTION That Article 12.01 -B of the Zoning Ordinance TWO: of the Village of Deerfield, as amended be and ORDINANCE NO. 0 -93 -53 AN ORDINANCE AMENDING PORTIONS OF ARTICLE 12 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD same is further amended by (i) numbering the first paragraph thereof "1" and titling said Paragraph "Exceptions," (ii) numbering the second paragraph thereof "3" and titling said Paragraph "Subdivision or Resubdivision," and (iii) by adding a new Article 12.01 -B,2 entitled "Improvements" as follows: "Improvements" In order to achieve the goals and objectives of the Planned Unit Development and the Village of Deerfield, the Village may determine that the best interests of the Village are served by permitting the provision of certain improvements as private rather than public improvements. It may also be determined that such improvements should be permitted at less than those specifications set out in the Zoning Ordinance, Deerfield Subdivision Code or the Municipal Code of Deerfield. Such exceptions shall be permitted at the discretion of the Corporate Authorities. The Corporate Authorities shall also determine the extent to which such improvements will be publicly owned and maintained. Such improvements shall include but shall not be limited to streets, sidewalks, street lights, fire hydrants, utility lines, and landscaping. The Corporate Authorities shall require the establishment of funds in accordance with the provisions of Article 12.09 and the Municipal Code to guarantee the establishment and completion of all improvements, whether private or public, as approved in the final development plan. Additionally, improvements other than those listed above which are approved as part of the final development plan shall be deemed to be included as private improvements and governed by Article 12.01 -G. Such improvements may include landscaping, fencing, and site amenities. The Corporate Authorities may grant exceptions to these requirements." ORDINANCE NO. 0 -93 -53 AN ORDINANCE AMENDING PORTIONS OF ARTICLE 12 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD SECTION That Article 12.09 -C of the Zoning Ordinance of THREE: the Village of Deerfield, as amended, be and the same is further amended by adding a new Article 12.09 -C,1,s as follows: "s. A preliminary improvement plan which indicates the extent of the various improvements contemplated by the PUD which are to be publicly owned and maintained, and those to be privately owned and maintained. A statement shall accompany the improvement plan which details the manner, if any, in which the improvements contemplated vary from the provisions of the Deerfield Development Code and Deerfield Standards and Specifications Manual." SECTION That Article 12.09 -F of the Zoning Ordinance FOUR: of the Village of Deerfield, as amended, be and the same is further amended by adding new Articles 12.09 -F,2,1 and 12.09 -F,2,m as follows: "1. Final Improvement Plan in accordance with the Deerfield Development Code, including a letter from the Village Engineer in accordance with Section 3 -101 of the Development Code. M. Proposed Development Agreement in accordance with the Deerfield Development Code." SECTION That the Village Clerk is hereby directed FIVE: to publish this Ordinance in pamphlet form.
