Collins ( "Petitioner ") the corporate authorities of the Village of Deerfield, after due investigation and consideration, have determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the vacation of a portion of the alley hereinafter described. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That a public alley in the Village of Deerfield, ONE: having heretofore been dedicated by a document recorded in the Office of the Recorder of Deeds of Lake County, Illinois, which portion of said alley is legally described on Exhibit A attached hereto and made a part hereof, as shown on and designated by the words "Alley Hereby Vacated" on the Plat hereto attached, which Plat for greater certainty is hereby made a part of this Ordinance, be and the same is hereby vacated and closed, inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation. SECTION That the alley vacation hereby approved is subject TWO: to the conditions that (i) Petitioner compensate the Village of Deerfield at the rate of $1.00 per square foot for the vacated portion of the alley and (ii) that Petitioner not interfere with the operation and maintenance of any existing overhead utilities in the vacated portion of the alley. SECTION That upon passage and approval of this Ordinance, THREE: the Village Clerk shall file for record in the Office of the Recorder of Deeds of Lake County, Illinois, a certified copy of this Ordinance, together with the Plat hereto attached. SECTION That all ordinances and parts of ordinances in FOUR: conflict herewith are, to the extent of such conflict, hereby repealed. SECTION That any violation of any of the conditions THREE: hereinabove set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Amendment to Special Use hereby authorized.
