O-93-39ORDINANCE NO. 0 -93 -39 AN ORDINANCE AMENDING THE OFFICIAL COMPREHENSIVE PLAN FOR THE VILLAGE OF DEERFIELD, ILLINOIS Published in pamphlet form this 16th day of August , 1993 by the President and Board of Trustees of Deerfield JKS930RDS.VODA1072693 ORDINANCE NO. 0 -93 -39 AN ORDINANCE AMENDING THE OFFICIAL COMPREHENSIVE PLAN FOR THE VILLAGE OF DEERFIELD, ILLINOIS WHEREAS, the Corporate Authorities of the Village of Deerfield and its residents, for more than 62 years, have been concerned with land use in the Village and have planned for the orderly growth and development of the Village as evidenced by the following; and WHEREAS, the Corporate Authorities have previously reviewed and updated the Comprehensive Plans which have been adopted from time to time by the Village; and WHEREAS, on February 19, 1979, by passage of Ordinance 79 -6 the Corporate Authorities adopted the Official Comprehensive Plan presently in effect; and WHEREAS, Section Four of said Ordinance 79 -6 provides that said Official Comprehensive Plan may be amended from time to time; and WHEREAS, the President and of Deerfield have requested the to consider certain amendments and to prepare, pursuant to the seq., of the Illinois Municipal 1991) and recommend the same to Board of Trustees of the Village Village Plan Commission in 1993 to the Official Comprehensive Plan authority of Section 11 -12 -1, et Code (Chapter 24, Ill.Rev.Stat. the Corporate Authorities; and WHEREAS, the Village Plan Commission held several public hearings with respect to proposed amendments to the Official Comprehensive Plan and the various parts thereof, after published notice thereof, and thereafter, the Plan Commission formulated its recommendations thereon; and WHEREAS, the President and Board of Trustees have determined that it is in the best interests of the Village to adopt a certain amendment to the Official Comprehensive Plan and, in particular, to adopt the amendment as recommended by the Village Plan Commission and subsequently modified by the Corporate Authorities, it being understood that such Official Comprehensive Plan, as amended, may hereafter be supplemented and augmented by additional plans and maps, and that said Plan may hereafter be implemented by various ordinances which may be considered and adopted. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: ORDINANCE NO. 0 -93 -39 AN ORDINANCE AMENDING THE OFFICIAL COMPREHENSIVE PLAN FOR THE VILLAGE OF DEERFIELD, ILLINOIS SECTION Short Title. This Ordinance shall be known and ONE: may be cited as "An Ordinance Amending the Official Comprehensive Plan." SECTION Purpose. It is the purpose of this Ordinance to TWO: (a) adopt an amendment to the Official Comprehensive Plan, and (b) provide for the filing of copies of the Amended Plan in the Office of the Village Clerk for the information of the public, and the filing of notice of adoption of said Plan. SECTION Amendment to Plan Adopted. The Amendment to the THREE: Official Comprehensive Plan, attached hereto and made a part hereof, prepared by the Deerfield Plan Commission and as modified by the Corporate Authorities is hereby adopted and designated as the Amended Official Comprehensive Plan of the Village of Deerfield. SECTION Further Amendments. Either the Plan Commission or FOUR: the Board of Trustees in the manner provided by statute, may initiate or originate proposed further amendments to this Ordinance. SECTION Availability of Copies of the Ordinance. The FIVE: Village Clerk shall keep in the Village Hall for inspection by interested persons, copies of this Ordinance. This Clerk shall also make available copies of the Ordinance for purchase at cost, either through duplication in advance of contemplated demand or upon order as required. The foregoing copies of the Ordinance shall be in addition to the original copy which the statutes require the Village Clerk to keep as part of the official record of enacted ordinances. SECTION Severability. Any provisions of this Ordinance SIX: held invalid shall not affect the validity of the remaining provisions. SECTION Repeal. All ordinances or parts of ordinances in SEVEN: conflict herewith are, to the extent of such conflict, hereby repealed. SECTION Procedure for Adoption - Effective Date. This EIGHT: Amendment to the Comprehensive Plan Ordinance shall become effective upon its passage and approval, the filing of a notice of adoption of such Amendment to the Official Comprehensive Plan with the County Recorders of Lake ORDINANCE NO. 0 -93 -39 AN ORDINANCE AMENDING THE OFFICIAL COMPREHENSIVE PLAN FOR THE VILLAGE OF DEERFIELD, ILLINOIS and Cook Counties, which notices the Village Clerk is hereby directed to file, and upon the expiration of ten (10) days following the filing of such notice. ILLAGE PRESIDENT ATTEST: 3385200 POSSIBLE DEVELOPMENT AREA #11 NORTHWEST CORNER OF PFINGSTEN AND LAKE COOK ROADS The Village has previously approved the development of this property for multi- storied office buildings. Since those approvals, the surrounding areas have been developed in a manner which could make the previous approvals inappropriate and could adversely impact those existing uses. It is the Village's desire to control the development of this property so as to preserve and protect the existing development in the area and to encourage the development of this property in an innovative manner that will be beneficial to the property owners, the neighbors, and the Village as a whole. Specifically, the following objectives will be sought as well as all other applicable recommendations included in this plan: PREFERRED LAND USE OPTIONS The residential development of this parcel is the Village's first priority. The Village should take those steps necessary to encourage and to facilitate the residential development of this property. The Village should encourage the development of this parcel with a variety of housing types thereby expanding the range of housing options in the Village. Plans which incorporate creative design elements such as common open areas, innovative building configurations, and efficient site utilization will be encouraged. The Village recognizes that the property may draw interest for a mixed use development. This type of development would be considered only if it can be demonstrated that the development would not adversely impact traffic and other land uses in the area. INCOMPATIBLE LAND USES The Village strongly desires to contain and strengthen the existing business and office developments and to prevent strip commercial development. The retail development of this parcel could adversely impact all of the adjacent land uses and roads. 3385200 HIGH QUALITY DEVELOPMENT Existing development in the Village is characterized by the high quality of design and materials used, open space, and attractive landscaping. These characteristics are strongly desired for their high aesthetic value and enhancement of the residential character of the Village. ' AREAS TO THE NORTH AND WEST The Village strongly desires to protect and preserve the low density* housing development adjacent to and north and west of the property. The design and planning of the development should complement the small scale* and low density* of those areas. UTILITIES All utilities should be located underground. ACCESS a. Access to Lake Cook Road will be restricted and will not be permitted unless it can be demonstrated that such an access would be safe. Residential areas to the north will be protected from through traffic. b. Access to Pfingsten Road will be limited and located with respect to safety. If feasible, access points will be located so as to coordinate with those access points on the eAst side of Pfingsten Road. C. Direct access to the residential area to the north will only be permitted if the property is developed.in a residential manner which is compatible with the residential development to the north. Any such accesses should only be permitted if they provide advantageous traffic flows for all the residences involved. d. Ueh {`cu]a!r. access to the residential area to the west will no' ""`be .... permitted. OTHER CONSIDERATIONS a. The location of buildings and roadways, and the provisions of screening, berming and landscaping should be planned recognizing this property's location adjacent to a major arterial, a residential area, and a limited commercial area. b. The Village will take due consideration of the impact of the development of this property on the school systems serving this property. 3385200 7 1 .. C.
