Dated this August 6, 1993 a �_:: D. _ Village Clerk jMWW DEERRELD. awls MMS ORDINANCE NO. 0 -93 -38 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE FOR CONGREGATION B'NAI TIKVAH Published in pamphlet form this 2nd day of August , 1993 by the President and Board of 3 .385199 Trustees of Deerfield IN JKS93ORDS.VODA1072693 ORDINANCE NO. 0 -93 -38 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE FOR CONGREGATION B'NAI TIKVAH WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Congregation B'nai Tikvah ( "Applicant ") to amend the current Special Use in effect for the B'Nai Tikvah Synagogue currently under construction on the real property legally described on Exhibit 1 attached hereto and made a part hereof (the "Subject Property "), to permit the establishment of a nursery school as a portion of the religious education program as described by Applicant pursuant to the provisions of Articles 4.01 -C, 4 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced, including an Architectural Drawing of the educational wing prepared by Phillip Kupritz & Associates and the Traffic Report prepared by Barton Aschman & Associates, Inc., said Plan Commission made written findings of fact and recommended that the proposed Amendment to the Special Use of the Subject Property be approved. SECTION That the findings and recommendations of the Plan ONE: Commission as to the establishment of a nursery school as a portion of the religious education program as described by Applicant are concurred in and-adopted as the findings of the President and Board of Trustees and the Amendment to Special Use of the Subject Property to permit the establishment of a nursery school as a portion of the religious education program as described by Applicant all to be constructed on the Subject Property, be and the same is hereby authorized and approved. SECTION That the approval and authorization of said TWO: Amendment to Special Use is hereby given subject to the requirements that (i) all use shall be in accordance with all documents and representations submitted and made by Applicant to the Plan Commission, and the President and Board of Trustees, specifically including the Architectural Drawings attached as Exhibit 2 and all other documentary submissions and exhibits described in Section One hereof; and (ii) the Applicant shall comply with all other applicable provisions of the Zoning Ordinance and other applicable codes and ordinances of the Village of Deerfield. SECTION That failure of the Applicant to comply with the THREE: conditions set forth herein shall result in the 3 ORDINANCE NO. 0 -93 -38 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE FOR CONGREGATION B'NAI TIKVAH revocation of the permit for the Amendment to the Special Use. SECTION That all approval and authorization of said FOUR: Amendment to Special Use hereby given is subject to the requirement that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That the Village Clerk is hereby directed to FIVE: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and SIX: effect from and after its passage, approval and publication, as provided by law.
