ORDINANCE NO. 0 -93 -31
AN ORDINANCE AMENDING ORDINANCE NO. 0 -92 -38 ADOPTING
THE VILLAGE OF DEERFIELD STORMWATER MANAGEMENT CODE
WHEREAS, the Corporate Authorities of the Village of
Deerfield adopted a Stormwater Management Code as Ordinance No.
0 -92 -38 on August 17, 1992; and
WHEREAS, the Illinois Department of Transportation Division
of Water Resources ( "IDOT ") has reviewed Ordinance No. 0 -92 -38
and determined that certain additions and amendments are required
thereto; and
WHEREAS, the Corporate Authorities of the Village of
Deerfield have determined that the best interest of the Village
will be served by amending Ordinance No. 0 -92 -38 to include the
recommendations of IDOT.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That Ordinance No. 0 -92 -38 is hereby amended
ONE by adding thereto the following:
"SECTION This Ordinance is enacted pursuant to
EIGHT: the police powers granted to the Village
of Deerfield by Illinois Revised
Statutes, 1991, Chapter.24, pars. 1 -2 -1,
11- 12 -12, 11 -30 -8 and 11 -31 -2 an
Illinois Revised Statutes, 1991,
Chapter 19, par. 65(g).
SECTION This Ordinance is not intended to
NINE: repeal, abrogate or impair any existing
easements, covenants or deeded
restrictions. Where this Ordinance and
other ordinances, easements, covenants
or deed restrictions conflict or
overlap, whichever imposes the more
stringent restrictions shall prevail.
This Ordinance is intended to repeal
those portions of the original ordinance
or resolution which was adopted to meet
the National Flood Insurance Program
regulations which are in conflict
herewith, but is not intended to repeal
the resolution which the Village passed
in order to establish initial
eligibility for the program."

SECTION That Ordinance No. 0 -92 -38 is hereby
TWO: further amended by deleting appendix C to the
Village of Deerfield Stormwater Management Code
( "Code ") in its entirety and inserting in lieu
thereto the following:

SECTION That to the extent not specifically amended

FIVE: this Ordinance in pamphlet form.
