ORDINANCE NO. 0 -93 -29
AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS
OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY
COMMONLY KNOWN AS 901 NORTHWOODS DRIVE, DEERFIELD, ILLINOIS
WHEREAS, ROBERT AND JILL MOSS have petitioned for a
variation from the strict provisions of Articles 4.01 -F,3,b and
4.01 -F,3,e of the Zoning Ordinance of the Village of Deerfield,
passed April 17, 1978, as amended, as applied to the property
legally described below which would permit the construction of an
addition, connecting the existing residence to the existing
detached two car garage which would then be considered part of
the principal structure and would encroach approximately 21 feet
into the minimum 50 foot required rear yard and approximately 7
inches into the minimum required 10 foot side yard; and
WHEREAS, pursuant to notice duly published, as required by
statute, a public hearing on said petition was held and conducted
by the Zoning Board of Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the
President and Board of Trustees its written findings of fact and
recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendation
ONE: of the Zoning Board of Appeals are concurred in
and adopted as the findings of fact of the
President and Board of Trustees.
SECTION That the Board of Trustees finds that there
TWO: are practical difficulties and particular
hardships in the way of carrying out the
strict letter of the provisions of the Zoning Ordinance of the
Village of Deerfield as applied to Petitioner's property, which
is legally described on Exhibit A, attached hereto and made a
part hereof.
SECTION That a variation from the strict provisions of
THREE: Articles 4.01 -F,3,b and 4.01 -F,3,e of the Zoning
Ordinance of the Village of Deerfield, passed
April 17, 1978, as amended, with respect to the property
hereinabove described, is hereby granted so as to permit the
construction of an addition, connecting the existing residence to
the existing detached two car garage which would then be
considered part of the principal structure and would encroach
approximately 21 feet into the minimum 50 foot required rear yard
and approximately 7 inches into the minimum required 10 foot side
yard.

SECTION That the variation hereby granted is subject
FOUR: to compliance by the Petitioner with all other
applicable provisions of the Zoning Ordinance
and with all other applicable ordinances of the Village of
Deerfield.
SECTION That this Ordinance shall be in full force and
FIVE: effect from and after its passage and approval, as
provided by law.
