AN ORDINANCE AMENDING ARTICLE 8
OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of the
Deerfield Commons Shopping Center and Artemis Restaurant
(collectively "Applicant "), to consider a certain text amendment
to the Zoning Ordinance of the Village of Deerfield relative to
waiving parking requirements for seasonal outdoor food service
upon certain conditions and in certain circumstances; and
WHEREAS, said hearing was held pursuant to duly published
notice thereof and was in all respects held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield,
after considering the evidence adduced, made written findings of
fact and recommended a text amendment to the Zoning Ordinance of
the Village of Deerfield to achieve the objectives sought by the
Applicant; and
WHEREAS, the President and Board of Trustees of the Village
of Deerfield have determined that the recommendation of the Plan
Commission will serve the best interests of the Village of
Deerfield.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That Article 8, Section 8.02- E,2,i,(3) of the
ONE: Zoning Ordinance of the Village of Deerfield, as
amended, be and ,the same is further amended by
adding at the conclusion of the first sentence thereof, the
following:
", except in-those instances wherein the
Board of Trustees has determined, following a
public hearing by the Plan Commission and
receipt and review of a recommendation by
that body, that the outdoor food service
areas will not adversely impact parking for
the nearby area."
SECTION That the Village Clerk is hereby directed to

SECTION That this Ordinance shall be in full force and
