O-93-20ORDINANCE NO. 0 -93 -20 ECAPTURE ORDINANCE. LOTS 1- Aspen Way Subdivision WHEREAS, THE KOGEN GROUP, INC., is the owner or party interested in the property described as follows: Lots 1, 2, 3 and 4 of Aspen Way Resubdivision being a Resubdivision of the West 130 feet of Lot 127, the West 150 feet of Lot 128, the East 140 feet of Lot 142 and the East 150 feet of Lot 143, taken as one tract in the Subdivision of J.S. Hovland's First Addition to Deerfield, a Subdivision of the Southwest 4 (except the Northwest 4 of the Northwest 4 thereof) , of Section 32, Township 43 North, Range 12, East of the Third Principal Meridian, as shown on Plat of said Subdivision recorded November 7, 1924 as Document 248380, in Book "N" of Plats, Page 119, in Lake County, Illinois. and has caused to be constructed by private contract and has paid the cost thereof of certain road /street improvements and underground utility improvements consisting of storm sewer, water main and sanitary sewer extensions in certain portions of Aspen Way in said Subdivision in the Village of Deerfield; and WHEREAS, the said improvements so constructed are available to and may benefit adjoining and adjacent properties, specifically: Lot 144 of J.S. Hovland's First Addition to Deerfield, said First Addition being a Subdivision of the South West 4 (except the North West 4 of the North West 4 thereof), of Section 32, Township 43 North, Range 12, East of the Third Principal Meridian, as shown on Plat of said Subdivision recorded November 7, 1924 as Document 248380, in Book "N" of Plats, Page 56, in Lake County, Illinois.. AND Lot 2 of Blankenberg's Resubdivision of Lot 129 in the J.S. Hovland Subdivision First Addition to Deerfield, a Subdivision of the South West 4 (except the North West 4 of the North West 4 thereof) of Section 32, Township 43 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois. ORDINANCE NO. 0 -93 -20 ALSO Lot 2 in Kitzerow's Resubdivision Unit One being a Resubdivision of Lot 130 in J. S. Hovland's First Addition to Deerfield, a Subdivision of the South West a (except the North West ; of the North West a thereof) of Section 32, Township 43 North, Range 12, East of the Third Principal Meridian, all in Lake County, Illinois. WHEREAS, the construction of said improvement by private contract provides a substantial saving in cost to any person or property owner having present or future use and benefit thereof, as compared with the cost of the construction of such improvement by special assessment. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That no person, firm or corporation having an ONE: interest in the aforementioned Lot 2 of Blankenberg's Resubdivision and Lot 144 of J.S. Hovland's First Addition to Deerfield, excepting The Kogen Group, Inc., its successors or assigns, shall connect to or obtain service (except for fire protection) from the sanitary and storm sewers and watermain constructed and installed by the Kogen Group, Inc. in and about Aspen Way between Gordon Terrace and Laurel Avenue without first obtaining a permit for such connection or service.. No such permit shall be issued unless the applicant shall give evidence to the Village of Deerfield of payment to The Kogen Group, Inc. or its successors and assigns of such person's, firm's or corporation's proportionate share of the cost of such improvement as shown on the attached schedule which is made part of this Ordinance. Such payment to The Kogen Group, Inc. shall be in addition to the usual charges and fees payable to the Village for the issuance of such a permit. SECTION That no.planned development of the aforementioned TWO: Lot 2 of Blankenberg's Resubdivision and Lot 144 in J.S. Hovland's First Addition to the Village of Deerfield, shall be approved pursuant to the applicable provisions of the Village's Zoning and Subdivision Ordinances, unless as a condition of such approval, the applicant shall be required to pay his proportionate share of the costs of the aforementioned street and utility improvements as constructed and installed by The Kogen Group, Inc. in and about Aspen Way in accordance with the attached schedule. SECTION That the foregoing provisions of this Ordinance THREE: shall terminate ten (10) years after the date of passage. ORDINANCE NO. 0 -93 -20 SECTION That this Ordinance shall be in full force and FOUR: effect from and after its passage and approval as provided by law.
