O-93-15JKS93ORDS.VODA1032393/37 ORDINANCE NO. 0 -93 -15 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT (540 LAKE COOK ROAD) Published in pamphlet form this 12th day of April , 1993, by the President and Board of Trustees of Deerfield. 93ORDS.VODA1032393 \35 ORDINANCE NO. 0 -93 -15 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT (540 LAKE COOK ROAD) WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of American National Bank and Trust Company of Chicago, as Trustee under Trust No. 65110 and Matas Corporation (collectively the "Applicant ") to authorize an amendment to the previously approved Special Use for certain real estate to permit the installation of an automatic teller machine within the structure known as 540 Lake Cook Road described on Exhibit A hereto (the "Property ") developed as a Special Use - Planned Unit Development, under and pursuant to the provisions of Articles 6.01 -C,2, 12.01, 12.08 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, the President and Board of Trustees have considered and reviewed the Applicant's proposal dated February 16, 1993, attached hereto and made a part of hereof as Exhibit B; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by authorizing and granting permission to install an automatic teller machine at 540 Lake Cook Road pursuant to Article 6.01 -C, 2, b, 1 a of the Village of Deerfield Zoning Ordinance, all in accordance with Applicant's proposal marked Exhibit B, attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS AS FOLLOWS: SECTION That the President and Board of Trustees do ONE: hereby affirmatively find that the Amended Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 12.8 and 13.11 -D of the Village Zoning Ordinance, and the installation of the automatic teller machine as part of the Amended Special Use of JKS93ORDS.VODA1032393136 ORDINANCE NO. 0 -93 -15 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT (540 LAKE COOK ROAD) the Property, as and for purposes of an Industrial Planned Unit Development as set forth on Exhibit B be and the same is, hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said TWO: Amended Special Use of the Property as hereby granted is subject to compliance of the Applicant with its proposal attached as Exhibit B and all other terms and conditions of Ordinances applicable to the existing Special Use on the Property shall remain in full force and effect except to the extent specifically modified hereby. SECTION That any violation of any of the conditions THREE: hereinabove set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Amended Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to FOUR: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be full force and FIVE: effect from and after its passage, approval and publication as provided by law.
