O-93-13JKS93ORDS.VODA1030393 /20 ORDINANCE NO. 0 -93 -13 AN ORDINANCE AMENDING THE ZONING MAP AND AUTHORIZING A SPECIAL USE /UNIQUE USE - METRA COMMUTER RAILROAD STATION Published in pamphlet form this 12th day of April , 1993 by the President and Board of Trustees of Deerfield JKS93ORDS.VODA1030393 /21 ORDINANCE NO. 0 -93 -13 AN ORDINANCE AMENDING THE ZONING MAP AND AUTHORIZING A SPECIAL USE /UNIQUE USE - METRA COMMUTER RAILROAD STATION WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Regional Transportation Authority - Commuter Rail Division ( "Applicant ") for the classification of certain property (hereinafter the "Subject Property ") located within the Village in the P -1 Public Lands District and to authorize the development and use of the Subject Property legally described on Exhibit A hereto as a Special Use /Unique Use, under and pursuant to the provisions of Articles 7.00 and 13.12 for a commuter railroad station facility as hereinafter more particularly described on the Subject Property; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact recommending that the Zoning Map be amended to include the Subject Property in the P -1 Public Lands District; and WHEREAS, following consideration of the recommendations of the Plan Commission and the Phase I Site Improvement Plan by the President and Board of Trustees, the President and Board of Trustees have considered and reviewed the submitted Phase I Site Improvement Plan and Building Plan, each dated January 28, 1993, and prepared by SEC Donohue (collectively, the "Development Plan "); and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by reclassification of the Subject Property as proposed by the Plan Commission and the authorization and granting of said Special Use /Unique Use in accordance with the Development Plan for the Subject Property marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: ORDINANCE NO. 0 -93 -13 AN ORDINANCE AMENDING THE ZONING MAP AND AUTHORIZING A SPECIAL USE /UNIOUE USE - METRA COMMUTER RAILROAD STATION SECTION That the Zoning Map of the Village of Deerfield ONE: as included and made a part of the Village Zoning Ordinance passed April 17, 1978, as amended, is hereby further amended by zoning and classifying the property described in Exhibit "A", attached hereto and made a part hereof, to the P -1 Public Lands District. SECTION That the President and Board of Trustees do hereby TWO: affirmatively find that the Special Use /Unique Use as hereby authorized, fully complies with the requirements and standards set forth in Articles 7.00 and 13.12 of the Village Zoning Ordinance, and the Special Use /Unique Use of the real estate, as and for purposes of a commuter rail station facility as set forth on Exhibit B subject to certain conditions as more particularly set forth below, is hereby authorized and approved. SECTION That the approval and authorization of said THREE: Special Use /Unique Use is hereby granted subject to the requirements that all use, construction and development shall be in accordance with, in addition to the submitted Final Development Plan, all documentary and exhibit filings made, the terms of this Ordinance, all representations submitted and made by the Applicant to the Plan Commission and President and Board of Trustees and is also subject to compliance by Applicant with all other applicable provisions of the Village Zoning Ordinance. SECTION That the Special Use /Unique Use hereby authorized FOUR: shall be binding upon and inure to the benefit of Applicant's successors, grantees, transferees and assigns and any violation of the conditions hereinabove set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use /Unique Use hereby authorized. SECTION That the Village Clerk is hereby directed to FIVE: publish this Ordinance in pamphlet form and to record said Ordinance and that portion of Exhibit B known as the "Development Plan" in the office of the recorder of Deeds of Cook County, Illinois at Applicant's expense.
