O-93-11JKS930ORDS.VODA1030393 /15 ORDINANCE NO. 0 -93 -11 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 1265 WOODLAND DRIVE, DEERFIELD, ILLINOIS WHEREAS, MR. and MRS. JOHN NORRIS have petitioned for a variation from the strict provisions of Articles 10.01 -D,2 and 10.02 -A,2 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, as applied to the property legally described below which would permit a side yard of 4.7 feet in lieu of the required 5 feet and a combined side yard of 13.78 feet in lieu of the required 14 feet to accommodate an attached garage; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation ONE: of the Zoning Board of Appeals are concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That the Board of Trustees finds that there TWO: are practical difficulties and particular hardships in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioners' property, which is legally described below and made a part hereof. Lot 12 in Block 7 in Branigar Brother's Woodland Park, being a Subdivision of part of the North half of Section 29, Township 43 North, Range 12, East of the Third Principal Meridian, according to the plat thereof, recorded August 5, 1924 as Document 243980, in Book "M" of Plats, pages 84 and 85, in Lake County, Illinois. SECTION That a variation from the strict provisions of THREE: Articles 10.01 -D,2 and 10.02 -A,2 of the Zoning Ordinance of the Village of Deerfield, passed ORDINANCE NO. 0 -93 -11 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 1265 WOODLAND DRIVE, DEERFIELD, ILLINOIS April 17, 1978, as amended, with respect to the property hereinabove described, is hereby granted so as to permit a side yard of 4.7 feet in lieu of the required 5 feet and a combined side yard of 13.78 feet in lieu of the required 14 feet to accommodate an attached garage. SECTION That the variation hereby granted is subject FOUR: to compliance by the Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and FIVE: effect from and after its passage and approval, as provided by law.
