JKS920RDS.VODA2120392 /104 ORDINANCE NO. 0 -93 -02 AN ORDINANCE AMENDING ARTICLE 12 OF CHAPTER 22 OF THE MUNICIPAL CODE OF THE VILLAGE.OF DEERFIELD OF 1975, AS AMENDED, AND REVISING THE FINES AND PROCEDURES FOR CERTAIN PARKING VIOLATIONS WHEREAS, the Village of Deerfield has established a certain fine for the violation of handicapped parking regulations; and WHEREAS, the State of Illinois has established procedures for municipalities to request the suspension of driversl.licenses of persons having certain parking violations; and WHEREAS, the Mayor and Board of Trustees believe it is in the best interest of the Village to revise the fine for violations. of handicapped parking regulations and to provide procedures for the Village to request driver's license suspensions. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,. ILLINOIS, AS FOLLOWS:-- SECTIO That Section 22 -76A of Chapter 22� -of the' ONE: Municipal Code of the Village of Deerfield of 1975, as amended, be and is hereby further amended by deleting Subsection (b) and by substituting in lieu thereof, the following: "(b) In lieu of the penalty provisions prescribed in Section 22 -158 of this Article, any person violating any provision of this Section shall be- assessed a fine in the amount of not less than One Hundred Dollars ($100.00) for each offense and any such person may have his vehicle towed away from any parking area designated as a handicapped parking area and, thereafter, said vehicle shall be impounded by the Village and be assessed an impounding charge of Thirty Dollars ($30.00) and.a storage cost of Five Dollars. ($5.00) per day or fraction thereof for each day the vehicle is impounded." SECTIO That Section 22 -80 of Chapter 22 of the ' TWO: Municipal Code of the Village of Deerfield of 1975, as amended, be and is hereby further amended by adding at the end of the Section the following: "The Village may send a notice' of eligibility'' for driver's license suspension to the owner of'a-* registered vehicle who has failed to satisfy any fine or penalty imposed by final judgment for ten,. _ . 'A.tiF*' ORDINANCE NO. 0- 93� -02 AN ORDINANCE AMENDING ARTICLE 12 OF CHAPTER 22 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1975, AS AMENDED, AND REVISING THE FINES AND PROCEDURES FOR CERTAIN PARKING VIOLATIONS or more Village parking violations. Said notice shall be sent to the owner by first class United States mail, postage prepaid. All fines or penalties for such parking violations must be satisfied within forty -five (45) days of the notice date. Failure to either (i) satisfy said fines or penalties within forty -five (45) days, or (ii) to establish within forty -five (45) days to the Village's satisfaction that the notice recipient is not the owner or lessee of the vehicle or vehicles receiving ten or more parking violations or that the notice recipient has already paid the fines or penalties for the ten or more violations, shall result in the Village notifying the Secretary of State by a certified report that the registered owners driver's license is eligible for suspension. A copy of the certified report to be sent to the Secretary of :' State shall be available for review by the notice recipient during the forty -five (45) day period." SECTION That the Village Clerk is hereby directed to THREE: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and FOUR: effect from and after its passage, approval and publication as provided by law. AYES:.
