Dated this December 9, 1992 ROPERT D Village Clerk QQQ � A „ho rl s- cJJ. ��° 'og ®oxla,;aCao�looasal'�Y °b °+p° ' puf005 /13 -3 /23788 /saturn ` 11/10/92 - 1320 ORDINANCE NO: 0 -92 -56 ORDINANCE ADOPTING TAX INCREMENT ALLOCATION FINANCING IN THE VILLAGE OF DEERFIELD, ILLINOIS WHEREAS, the Village of Deerfield, Illinois desires to implement tax increment allocation financing pursuant to the Tax Increment Allocation Redevelopment Act, as amended, constituting Division 74.4 of Article 11 of the Illinois Municipal Code (here- inafter referred to as the "Act ") for the Redevelopment Plan and Redevelopment Project heretofore approved and adopted pursuant to an ordinance adopted by the President and Board of Trustees of the Village on December 7, 1992 and entitled: "Ordinance Adopting and Approving a Tax Increment Redevelopment Plan and a Tax Incre- ment Redevelopment Project for the Village of Deerfield, Illinois" (the "Redevelopment Ordinance ") ; and WHEREAS, the Village has designated the area referred to in said plan as a Redevelopment Project Area as provided in the Act pursuant to an ordinance adopted by the President and Board of Trustees of the Village on December 7 , 1992 and entitled: "Ordinance Designating a Tax Increment Redevelopment Project Area in the Village of Deerfield, Illinois" (the "Designation Ordi- nance"); and WHEREAS, by virtue of the adoption of the Redevelopment Ordinance and the Designation Ordinance, the Village has amended its redevelopment plan adopted December 15, 1986, and has altered the exterior boundaries of its redevelopment project area desig- nated on December 15, 1986, all as permitted by Section 11- 74.4 -5 of the Act. 3258537 A NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, ILLINOIS, AS FOLLOWS: Section 1. Tax increment allocation financing is hereby adopted with respect to the Redevelopment Plan and the Redevelop- ment Project approved and adopted pursuant to the Redevelopment Ordinance in the Village of Deerfield in respect to the Redevelop- ment Project Area described in Exhibit A to this ordinance and designated pursuant to the Designation Ordinance. Section 2. Ad valorem taxes, if any, arising from the levies upon taxable real property in the Redevelopment Project Area by taxing districts and tax rates determined in the manner provided in paragraph (c) of Section 11= 74.4 -9 of the Act each year after the effective date of this ordinance until the redevel- opment project costs and obligations financing redevelopment proj- ect costs incurred have been paid shall be divided as follows: (a) That portion of taxes levied upon each taxable lot, block, tract or parcel of real property which is attributable to the lower of the current equalized assessed value or the initial equalized assessed value of each such taxable lot, block, tract or parcel of real property in the Redevelopment Project Area shall be allocated to and when collected shall be paid by the county collector to the respective affected taxing districts in the manner required by law in the absence of the adoption of tax increment allocation financing. 325853' 3 -2- (b) That portion, if any, of such taxes which is at- tributable to the increase in the current equalized assessed valuation of each taxable lot, block, tract or parcel of real property in the Redevelopment Project Area over and above the initial equalized assessed value of each property in the Re- development Project Area shall be allocated to and when col- lected shall be paid to the Village Treasurer who shall de- posit said funds in a special fund called the "Special Tax Allocation Fund" of the Village for the purpose of paying re- development project costs and obligations incurred in the payment thereof. If the Village does not extend an ad valorem tax arising from levies on taxable real property to be included in the deter- mination of incremental revenues in the manner provided in para- graph (c) of Section 11- 74.4 -9 of the Act, it shall annually de- posit in the Special Tax Allocation Fund an amount equal to 10$ of the total contributions to the Special Tax Allocation Fund from all other taxing districts in that year. The Village hereby pledges the funds in and to be de- posited in the Special Tax Allocation Fund for the purpose of pay- ing redevelopment project costs and obligations incurred in the payment thereof. Section 3. The Village Clerk be and is hereby directed to publish this ordinance in pamphlet form and to file a certified copy of this ordinance with the County Clerk of Lake County. Section 4.
