ORDINANCE NO. 0 -92 -32
AN ORDINANCE AUTHORIZING THE ACQUISITION OF
PROPERTY THROUGH CONDEMNATION OR OTHERWISE
WHEREAS, the President and Board of Trustees of the Village
of Deerfield have determined that the acquisition of certain
property hereinafter described for the purpose of widening a public
street known as Country Lane is necessary, useful, advantageous and
desirable for the Village of Deerfield and the acquisition of said
property constitutes a public purpose; and
WHEREAS, the Village of Deerfield is authorized to exercise
the power of eminent domain for the purpose of acquiring property
for the proposed widening of a public street pursuant to the
provisions of §11 -61 -1 and §11 -61 -2 of Chapter 24 of the Illinois
Revised Statutes;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE COUNTY, ILLINOIS:
SECTION ONE: That it is hereby determined that the following
described property, to -wit:
The south 25 feet of lot 133 in the subdivision of J.S.
Hovland's First Addition to Deerfield, being a
subdivision of the southwest 1/4 (except the northwest
1/4 of the northwest 1/4 thereof) of Section 32, Township
34 N, Range 12, east of the third principal meridian in
Lake County, Illinois
Recorded November 7, 1924 as Document #248380
and
The south 25 feet of lot!134 in the subdivision of J.S.
Hovland's First Addition to Deerfield, being a
subdivision of the southwest 1/4 (except the northwest
1/4 of the northwest 1/4 thereof) of Section 32, Township
43 N, Range 12, east of the third principal meridian in
Lake County, Illinois
Recorded November 7, 1924 as Document #248380
be acquired for the purpose of widening a public street, known as
Country Lane. That the acquisition of said property for the
purpose of widening a public street is necessary and convenient for
public use and is authorized by the statute in such cases made and
provided.
SECTION TWO: That it is hereby determined that it is
necessary, useful, advantageous and desirable that the Village
shall acquire title to and possession of the real estate
hereinabove described which real property is necessary, required
and needed for the widening of Country Lane for the public welfare,
which property lies wholly within the limits of the Village of
Deerfield.
SECTION THREE: That the Village Manager and the Special
Village Attorney, JACK M. SIEGEL, be and they are hereby
authorized, empowered and directed to negotiate with the owner or
owners of the hereinabove described real estate for the purpose of
acquiring the same by said Village.
SECTION FOUR: That in the event that the Village is unable
to agree with the owners of said property as to the compensation
to be paid therefor, then title and possession of said real
property legally described hereinabove shall be acquired by the
Village of Deerfield through condemnation and JACK M. SIEGEL,
as special attorney for the Village is hereby authorized, empowered
and directed to institute proceedings in any court of competent
jurisdiction to acquire title to and possession of said property
for said Village in accordance with the eminent domain laws of the

SECTION FIVE: This ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form in the manner provided by law.

Hall, commencing on July 7 , 1992, and continuing
for at least ten days thereafter. Copies of such ordinance were
also available for public inspection upon request in the Office
of the Village Clerk.
