CROMIE, Deputy Village Clerk A ORDINANCE NO. 0 -92 -31 AN ORDINANCE AUTHORIZING A SPECIAL USE -DRIVE THROUGH FACILITY OPERATED IN CONNECTION WITH DRY - CLEANING OR LAUNDRY ESTABLISHMENT Published in pamphlet form this 6th day of July , 1992, by the President and Board of Trustees of Deerfield. 3191801 ORDINANCE NO. 0 -92 -31 'AN ORDINANCE AUTHORIZING A SPECIAL USE -DRIVE THROUGH FACILITY OPERATED IN CONNECTION WITH DRY - CLEANING OR LAUNDRY ESTABLISHMENT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Thomas Zengeler (the "Applicant ") for approval of a Special Use for a drive through facility operated in connection with dry - cleaning or laundry establishment on the premises legally described in Exhibit A attached hereto and made a part hereof under and pursuant to the provisions of Articles 5.01- C,2,f, 13.04 -B and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, including the Site Plan prepared by Applicant (the "Site Plan ") and attached hereto as Exhibit B, made written findings of fact and recommended that the Special Use as proposed be approved and authorized subject to certain conditions and restrictions hereinafter set forth; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the approval of the Special Use in accordance with the testimony and documentary evidence including Exhibit B presented by Applicant to the Corporate Authorities. NOW, THEREFORE, BE IN ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do ONE: hereby affirmatively find that the Special Use as proposed by Applicant fully complies with the requirements and standards set forth in Article 13.11 -D of the Zoning Ordinance of the Village of Deerfield and the Special Use of the real estate, as and for purposes of a drive through facility operated in connection with dry - cleaning or laundry establishment in accordance with Exhibit B as proposed by Applicant, be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said TWO: Special Use hereby granted is subject to the following conditions: 31�1��1 _t ORDINANCE NO. 0 -92 -31 AN ORDINANCE AUTHORIZING A SPECIAL USE -DRIVE THROUGH FACILITY OPERATED IN CONNECTION WITH DRY - CLEANING OR LAUNDRY ESTABLISHMENT a. The two (2) unmarked parking spaces located directly east of the existing building shall be marked "No Parking ". b. A speed bump shall be installed at the southeast corner of the existing building. C. A "Do Not Sound Horn" sign shall be placed on the building at the entry to the drive through window. d. Lighting shall be restricted to the soffit of the overhang of the drive through area. e. A light barrier shade shall be provided for the drive through window during non - business hours. SECTION That any violation of the conditions THREE: hereinabove set forth shall authorize the revocation of the special use hereby authorized. SECTION That the Village Clerk is hereby directed to FOUR: publish this Ordinance in pamphlet form and to record said Ordinance in the Office of the Lake County Recorder of Deeds at Applicant's expense. SECTION That this Ordinance shall be in full force FIVE: and effect, from and after its passage, approval and publication, as provided by law. AYES: Ehlers, Marovitz, Rosenthal,.
