AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR DEERBROOK SHOPPING CENTER Published in pamphlet form this 20th day of April , 1992 by the President and Board of Trustees of Deerfield ORDINANCE NO. 0- 92 -20, AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR DEERBROOK SHOPPING CENTER WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Deerbrook Bank and LaSalle National Bank as`•successor trustee to LaSalle Northwest National Bank, formerly known as Northwest National Bank of Chicago, as trustee of Trust No. 122 dated April 3, 1968 and Trust No. 10- 072680 dated February 7, 1984 (hereinafter collectively referred to as "Applicant "), to authorize an amendment to the existing Special:. Use - Planned Unit Development of Deerbrook Shopping Center to.permit the expansion of the existing drive through facility into an expanded free standing banking facility at the Deerbrook.Shopping Center pursuant to Article 2.00 -C,2 and 5.02 -C,2,c of the Zoning Ordinance.of the Village of Deerfield, as amended ;'and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission.of - the Village of Deerfield after considering and reviewing the testimony and documentary evidence adduced by the Applicant including the Preliminary Site Plan dated December 16, 1991 prepared by J. BABAT, Architect.made written findings of fact and recommended that said amendment to the Special Use of said real estate be approved and authorized subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan ONE: Commission as to the.proposed expansion of the existing drive through facility into an expanded free standing banking facility are concurred An and adopted as the findings of the President and Board of Trustees and the amendment to the Special Use of the real estate legally described in Exhibit A attached hereto and made a part hereof to approve the proposed expansion of the existing drive through facility. into an expanded free standing banking facility be and the same is hereby authorized and approved. ORDINANCE NO. 0 -92 -20 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR DEERBROOK SHOPPING CENTER SECTION That the approval and authorization of said TWO: amended Special Use is hereby given subject to the requirements that all use shall be in accordance with, all exhibits, testimony, representations submitted. and made by the Applicant to the Plan Commission and President and Board of Trustees specifically including the revised Site Plan (the "Final Site Plan ") dated March 20 , 1992, , prepared by J. BABAT, Architect, and attached hereto as Exhibit B and made a part hereof and is also subject to (i) adequate lighting being provided in both the depository and in and around the cash station; (ii) a sidewalk being provided along-the east side of the building; (.iii) handicapped parking spaces being provided at the north side of the building; (iv) the.improvements complying with the American with Disabilities Act; (v) the existing lighting being balanced with the new lighting; and (vi)_ the Applicant design. the facility so that the security camera is activated by inserting the cash station card into the entry door to the cash station room and further, to compliance by Applicant with all other applicable provisions of the Zoning Ordinance and other applicable ordinances of the Village of Deerfield. SECTION That any violation of the conditions hereinabove THREE: set forth shall authorize the revocation of the amendment to Special Use hereby authorized. SECTION That all approval and authorization of said FOUR: amendment to Special Use hereby given is subject to the requirement that this Ordinance shall _be recorded in the Office of the Recorder of Deeds of Cook County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That the Village Clerk is hereby directed to FIVE: publish this Ordinance in pamphlet form.
