PIA �'s ORDINANCE NO. 0 -92 -12 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE FOR CONGREGATION B'NAI TIKVAH Published in pamphlet form this 16th day of March , 1992 by the President and Board of Trustees of Deerfield 31355'73 :k JKS92ORDS.VODA3031292/26 ORDINANCE NO'. 0 -92 -12 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE FOR CONGREGATION B'NAI TIKVAH WHEREAS,. the Plan Commission of the Village of Deerfield has heretofore held a,public hearing on the application of Congregation B'nai Tikvah ( "Applicant ") to amend the current Special Use in effect for the presently existing Wilmot Road Baptist Church facility located on the real property legally described on Exhibit 1 attached hereto and made a part hereof (the "Subject Property "), to permit an addition to the facility and the replacement of the existing use with.a synagogue including a sanctuary, social hall, classrooms, administrative space and other facilities as described by Applicant pursuant to the provisions of Articles 4.01 -C, 4 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in.all respects held according to law;-and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced, including an Architectural Site Plan (the "Preliminary Plan ") prepared by Phillip Kupritz & Associates, said Plan Commission made written findings of fact and recommended that the proposed Amendment to the Special Use of the Subject Property be denied. .SECTION That the *findings and recommendations of the Plan ONE: Commission as to the replacement of the existing church use with a synagogue to include a sanctuary, social hall, classrooms, administrative space and other facilities as described by Applicant are not concurred in and adopted as the findings of the President and Board of Trustees but rather following a review and consideration-of all evidence adduced including (i) revisions.to the Preliminary Site Plan presented to the President and Board of Trustees as the Final Site Plan prepared by Phillip Kupritz & Associates, dated February 3, 1992 and attached hereto and made a part hereof as Exhibit 2, (11) Site Statistics - Exhibit A -1 dated February 3, 1992, (iii) Engineering Site Plan - Exhibit C dated December 18, 1991, (iv) Ground Floor and Landscaping Plan - Exhibit D -1 dated March 12, 1992, (v) Exterior perspective - Exhibit E -1 dated February 3, 1992, (vi) Interior perspective - Exhibit F dated December 18, 1991, (vii) Parking Lot Photometrics (Lighting) - Exhibit G -1 dated March 5, 1992, (viii) Site Geometry. Plan - Exhibit H dated January 2, 1992, (ix) Aerial View consisting of a colored drawing showing the reinforced subbase for on -site 31.355'73 3 ORDINANCE NO. 0 -92 -12 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE FOR CONGREGATION B'NAI TIKVAH overflow parking - Exhibit J -1 dated March 12, 1992, (x) Front Yard Design - Exhibit K -1 dated March 12, 1992, (xi) Wilmot Road Elevation - Exhibit L -1 dated March 12, 1992, the Amendment to Special Use of the Subject Property, for a replacement of the presently existing Wilmot Road Baptist Church with a synagogue including a sanctuary, social hall, classrooms, administrative space and other facilities as described by Applicant all to be constructed on the Subject Property, be and the same is hereby authorized and approved. SECTION That the approval and authorization of said TWO: Amendment to Special Use is hereby given subject to the requirements that (i) all use shall be in accordance with all documents and representations submitted and made by Applicant to-the-Plan Commission,.and the President and Board of Trustees, specifically including the Final Architectural Site Plan attached as Exhibit 2 and all other documentary submissions and exhibits described in Section One hereof; (ii) the Applicant shall provide a total of 81 parking spaces for overflow parking on a reinforced grass area in those areas depicted on Applicant's Exhibit J -1 described in Section One hereof and Applicant shall remain responsible for landscape maintenance and restoration of any damage caused by said overflow parking in the right -of -way adjoining said areas; (iii) the Applicant shall provide storm water drainage for the Subject Property at its expense by connection to the planned Wilmot Road storm sewer in accordance with plans and specifications therefor to be reviewed and approved by the Village Engineer; (iv) Applicant shall dedicate the east thirty -three (33) feet of the Subject Property to the Village of Deerfield; (v) the Applicant, on those limited occasions where off -site parking is anticipated shall use its best efforts to locate said parking on the west . side of Wilmot Road; and (vi) the Applicant shall comply with all other applicable provisions of the Zoning Ordinance and other applicable codes and ordinances of the Village of Deerfield. SECTION That failure of the Applicant to comply with the THREE: conditions set forth herein shall result in the revocation of the permit for the Amendment to the Special Use.
