ORDINANCE NO. 0 -91-42 AN ORDINANCE VACATING PORTIONS OF A CERTAIN STREET IN THE VILLAGE OF DEERFIELD WHEREAS, the President and Board of Trustees of the Village of Deerfield after due investigation and consideration, have determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the vacation of portions of Potomac Avenue,hereinafter described: NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That those portions of a public street in the ONE: Village of Deerfield having heretofore been dedicated by a document recorded in the Office of the Recorder of Deeds of Lake County, Illinois, which portion of said street is legally described on Exhibit A attached hereto and .made a part hereof, as shown on and designated by the words "Hereby Vacated" on the Plat hereto attached, which Plat for greater certainty is hereby made a part of this Ordinance, be and the same is hereby vacated and closed,.inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation. SECTION That the Village of Deerfield reserves in TWO: perpetuity an easement over, under and across that portion of the vacated property as depicted and legally described on the Plat of Vacation, along with the right of access thereto. SECTION That upon passage and approval of this Ordinance, THREE: the Village Clerk shall file for record in the Office of the Recorder of Deeds of Lake County, Illinois, a certified copy of this Ordinance, together with the Plat hereto attached. SECTION That this Ordinance shall be in full force and FOUR: effect from and after its passage, approval and publication, as provided by law.
