AN ORDINANCE AUTHORIZING A CLASS A
SPECIAL USE - C -1 VILLAGE CENTER DISTRICT
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of AMERICAN
NATIONAL BANK & TRUST COMPANY OF CHICAGO, as Trustee under Trust
Agreement dated February 20, 1987 and known as Trust No. 101423-
05, BANBURY DEVELOPMENT, INC. and ANGELIZA, INC. (collectively,
the "Applicant "), to authorize the development and use of certain
real estate described on Exhibit A hereto for a Class A Special
Use as a store selling handcrafted jewelry, make -up and skin care
products and providing cosmetology services consisting of make-
up application and skin care, facials, manicures, pedicures,
massages and waxing services on the ground floor level under and
pursuant to the provisions of Articles 5.01 -C, 1, d and 13.11 of
the Zoning Ordinance of the Village of Deerfield; and
WHEREAS, said hearing was held pursuant to duly published
notice thereof and was in all respects held according to law; and
WHEREAS, following consideration of the recommendations of
the Plan Commission by the President and Board of Trustees, the
President and Board of Trustees have considered and reviewed the
proposed Class A Special Use as a store selling handcrafted
jewelry, make -up and skin care products and providing cosmetology
services consisting of make -up application and skin care,
facials, manicures, pedicures, massages and waxing services on
the ground floor level, as submitted by Applicant; and
WHEREAS, the President and Board of Trustees of the Village
of Deerfield have determined that the best interests of the
Village will be served by the authorization and granting of said
Class A Special Use in accordance with all the testimony and
evidence presented by the Applicant for the Subject Property.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the President and Board :of Trustees do hereby
ONE: affirmatively find the Special Use, as hereby
authorized, fully complies with the requirements
and standards set forth in Articles 5.01 -C, 1, d and 13.11 of the
Village Zoning Ordinance and the Class A Special Use of the
Subject Property, as a store selling handcrafted jewelry, make-
up and skin care products and providing cosmetology services
consisting of make -up application and skin care, facials, ,
manicures, pedicures, massages and waxing services on the ground
floor level, be and the same is, hereby authorized and approved
subject to the conditions hereinafter set forth.

SECTION That the approval and authorization of said

for the use as more specifically described above
and as hereby granted is subject to the conditions that (i) the
Class A Special Use hereby granted terminates and lapses upon the
cessation of business by Angeliza, Inc. at the location described
herein, (ii) the cosmetology services provided by Angeliza, Inc.
shall be limited to those described herein and shall not include
beauty shop services and (iii) said Class A Special Use conform
to all other applicable codes, ordinances and regulations of the
Village of Deerfield.
SECTION That any violation of any of the conditions
THREE: hereinabove set forth by the Applicant or its
successors, grantees, transferees or assigns shall
authorize the revocation of the Class A Special Use hereby
authorized.
SECTION That the Village Clerk is hereby directed to
FOUR: publish this Ordinance in pamphlet form.
SECTION That this Ordinance shall be in full force and
FIVE: effect from and after its passage, approval and
publication, as provided by law.
