Dated this August 6 , 1991 "ROBERT FRANZ, Villag-e*C - 7�m : S6, / Dee'41-eld 69015 �j JKS91ORDS.VODA2071691 ORDINANCE NO. 0 -91 -35 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE- INDUSTRIAL PLANNED UNIT DEVELOPMENT Published in pamphlet form this 5th day of August , 1991, by the President and'Board of Trustees of Deerfield. 30'76899 U JKS91ORDS.VODA2071691/59 ORDINANCE NO. 0 -91 -35 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the CORPORATE 500 PHASE III, an Illinois Limited Partnership and CHICAGO PROFESSIONAL SPORTS LIMITED PARTNERSHIP (collectively, the "Applicant "), to authorize an amendment to Village Ordinance Nos. 0 -84 -63 and 0 -88 -70 to provide for the development and use of a portion of that certain real estate described on Exhibit A hereto (the "Subject Property ") as Special Use - Planned Unit Development under and pursuant to the provisions,of Articles 6.0.1 -C, 12.01, 12.08, 12.09 and 13.11 of the Zoning Ordinance of the Village of Deerfield for development of the Subject Property with a private sports training facility and associated offices and summer sports day camp, and related uses as hereinafter more particularly described; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission and the Preliminary Development Plan by the President and Board of Trustees, the President and Board of Trustees have considered and reviewed the submitted Final Development Plan, dated July 12, 1991, prepared by Rick Strusiner Associates, Architects, attached hereto and made part hereof as Exhibit B); and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of.said Amendment to Ordinance Nos. 0 -84 -63 and 83 -70; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do ONE: hereby affirmatively find that the Amended Special Use as hereby authorized, fully complies with the requirements and standards set forth in Articles 6.01, 12.01, 12.081and 13.11 of the Zoning Ordinance and that the Amended Special Use of the real estate as and for purposes of a private sports training facility and associated offices and summer sports day camp as set forth on Exhibit B, subject to certain conditions as more particularly set forth below, be and the same are hereby authorized and approved. 3076899 .3 ORDINANCE NO. 0 -91-35 AN ORDINANCE AUTHORIZING AN AMENDMENT TO . A SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT SECTION That the approval and authorization of said TWO: Amended Special Use hereby granted is subject to the following conditions: (A) That all use construction and development shall be in accordance with the Final Development Plan and with all other documentary and exhibit filings made pursuant to Planned Unit Development Procedures as set forth in Article 12.09 of the Village Zoning Ordinance, the terms of this Ordinance, and all representations by the Applicant to the Plan Commission and to the Village President and Board of Trustees. (B) That said use of the Subject Property for Summer Sports Day Camp activities shall be restricted to the hours of 8:00 a.m. to 6:00 p.m. Monday through Saturday. (C) That the Applicant shall furnish a Cross Easement Agreement satisfactory in form and substance to the Corporate Authorities of the Village providing additional off -site parking spaces for overflow parking for special events taking place from time to time on the Subject Property. (D) The parking space ratio is to be established at one (1) space for each 750 square feet of building area. (E) Only white lighting shall be used at the Subject Property with security lighting to be kept to a minimum, lighting on the north elevation to be limited to wash lighting and with lighting on the south side of the Subject Property adjusted to avoid intrusion into adjoining properties. (F) Each tree removed at the north end of the Subject Property shall be replaced by a tree eight (8) to ten (10) inches in diameter. 30'76899 4 ORDINANCE NO. 0 -91 -35 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT SECTION That the Special Use hereby authorized shall THREE: be binding upon and inure to the benefit of Applicant's successors, grantees, transferees and assigns and any violation of the conditions hereinabove set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to FOUR: publish this Ordinance in pamphlet form and to record said Ordinance and that portion of Exhibit B known as the "Final Development Plan" in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION That except as amended hereby the terms of FIVE: Ordinance Nos. 0 -84 -63 and 0 -88 -70 shall remain in full force and effect. SECTION That this Ordinance shall be in full force and SIX: effect from and after its passage, approval and publication, as provided by law.
