AN ORDINANCE AMENDING SECTION 22 -167 OF
ARTICLE 21 OF CHAPTER 22 OF THE MUNICIPAL
CODE OF THE VILLAGE OF DEERFIELD OF 1975
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Section 22 -167 of Article 21 of Chapter 22 of the
ONE: Municipal Code of the Village of Deerfield of 1975,
entitled "Exhibit G. Fire Lanes designated. ", as
amended, be and the same is hereby further amended by adding to the
list of locations designated as fire lanes, the following:
"Lake Cook Office Center. A 10' wide lane extending
across those portions of the Lake Cook Office Center
property, 1419 Lake Cook Road, as more fully described
in a certain agreement dated June 12 , 1991, by
and between the Village of Deerfield and M & J Wilkow
Management Corporation, as Agent for the Lake Cook
Office Development Company Building Four Limited
Partnership."
SECTION That the Village Clerk is hereby directed to publish
TWO: this ordinance in pamphlet form.
SECTION That this ordinance shall be in full force and effect
THREE: from and after its publication, as provided by law.

FIRE LANE
AGREEMENT
The Village of Deerfield, a Home Rule Municipal Corporation
pursuant to Article 7 of the Constitution of the State of Illinois,
hereinafter referred to as "the Village ", and M & J Wilkow Management
Corporation, as agent for Lake Cook Office Development — Building Four,Limited
Partnership ,
hereinafter referred to as "the Owner ", do hereby covenant and
agree, one with the other, THAT:
WHEREAS, the Owner's Property, located at
1419 Lake Cook Road in the Village of Deerfield, known
as LAKE COOK OFFICE'CENTER contains a variety
of commercial establishments in abutting structures; and
WHEREAS, the use of said structures are generally open to the
public, customers, clients and employees, thereby increasing the
high -risk nature of the commercial use of said property, and
WHEREAS, available off - street parking for employees and
customers of LAKE COOK OFFICE CENTER ,
together with maneuvering aisles and traffic flow control, is
entirely upon the private property of the owner; and
WHEREAS, the constant assurance of immediate ingress and
access-to all exposures of existing structures by emergency fire
and police vehicles is desirable for the purpose of providing
maximum protection of life and property; and
WHEREAS, the Municipal Code of the Village provides a means of
establishing and controlling such access assurance through the
establishment of fire lanes.
NOW, THEREFORE, in consideration of the mutual covenants
herein contained and the reciprocal benefits to the parties, it is
agreed as follows:
1. That this agreement is entered into pursuant to the
provisions of Section 11 -209 of Chapter 95 -1/2 and Section 1 -1 -7 of
Chapter 24, Illinois Revised Statutes of 1989.
2. That the M& J W I L KOW MANAGEMENT CORPORATION
requests and authorizes the Village to establish and maintain
ten -foot wide fire lanes at those locations on Owner's
property at 1419 Lake Cook Road as are
indicated on the Fire Lane Agreement Exhibit attached hereto and
made a part hereof.
3. That the fire lanes hereinabove referred to shall be for
the express purpose of providing unrestricted access for emergency
vehicles, but it is not the intent or purpose of the parties hereto
to limit or restrict the use of said fire lanes for ingress and
egress by the public to the property unless and until an emergency
use of such lanes is required. Such fire lanes shall be available
for such use by the public except that the parking and standing of
unattended motor vehicles shall be prohibited therein.
4. That said fire lanes shall be appropriately posted with
signs . and the M& J W I L K O W MANAGEMENT CoRpoR iomha l l pay
the cost of said signs and the cost of installation and maintenance
thereof.
5. The Village shall enforce the restrictions against the
parking and standing of vehicles in said fire lanes herein agreed
to.
6. That the Village will cause this Agreement to be promptly
recorded with the COOK County Recorder of Deeds' Office at Owner's
expense.
