ORDINANCE NO. 0 -91 -23 AN ORDINANCE AMENDING THE ZONING MAP AND APPROVING A 2 LOT SUBDIVISION Published in pamphlet form this 3rd day of June , 1991 by the President and Board of Trustees of Deerfield 3046084 / JKS91ORDS.VODA1050891 ORDINANCE NO. 0 -91 -23 AN ORDINANCE AMENDING THE ZONING MAP AND APPROVING A 2 LOT SUBDIVISION WHEREAS, the Plan Commission of the Village of Deerfield has heretofore'held a public hearing on the Petition of LA SALLE NATIONAL TRUST, N.A., as Successor Trustee to LA SALLE NATIONAL BANK, as Successor Trustee to EXCHANGE NATIONAL BANK OF CHICAGO, which merged with CENTRAL NATIONAL BANK IN CHICAGO,.not personally, but as Trustee under Trust Agreement dated december 10, 1974, and known as Trust No. 10- 21001 -08 (hereinafter referred to as "Applicant "), for the classification of certain real estate located within the Village, and hereinafter described, in the R -1 Single - Family District, and to authorize the subdivision thereof into 2 lots in accordance with Exhibits presented to the Plan Commission; and WHEREAS, said hearing was held pursuant to duly authorized notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact and recommended a map amendment to the Zoning Ordinance of the Village of Deerfield and the approval of the subdivision to achieve the objectives sought by the Applicant; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the classification of said real estate in the manner aforesaid. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the Zoning Map of the Village of Deerfield ONE: included and made a part of the Village Zoning Ordnance passed April 17, 1978, as amended, is hereby further amended by zoning and classifying the property described in Exhibit "A ", attached hereto and made*a part hereof, to the R -1 Single Family District. SECTION That the Preliminary Plat of Subdivision and TWO: Preliminary Site Plan, each prepared by Cowhey, Gudmundson Teder, Ltd. dated 2 -21 -1991 , for the above - described property is hereby approved, including granting of approval of a cul -de -sac length variation of approximately 18 feet in length in lieu of the 300 foot maximum 3046®84 W-A . .1a ORDINANCE NO. 0 -91 -23 AN ORDINANCE AMENDING THE ZONING MAP AND APPROVING A 2 LOT SUBDIVISION length permitted and a variation allowing the elimination of sidewalks. SECTION That the map amendment and Preliminary Plat THREE: approval hereby granted is conditioned upon and subject to: (a) submission of a Final Plat of Subdivision; (b) compliance with all engineering requirements as determined by the Village Engineer; (c) execution of a Restrictive Covenant in form and content satisfactory to the Village of Deerfield providing adequately for Applicant's compliance with the terms and provisions of a certain Annexation Agreement between the Applicant and the Village of Deerfield with respect to the property described in Exhibit A, and (d) compliance with all other applicable codes and ordinances of the Village of Deerfield. SECTION That the Village Clerk is hereby directed to FOUR: publish this Ordinance in pamphlet form. . SECTION That this Ordinance shall be in full force and FIVE: effect from and after its passage, approval and publication, as provided by law.
