RESOLUTION NO. R-24-22
A RESOLUTION AUTHORIZING AND APPROVING
MID-TERM AGREEMENTS WITH THE TWO
COLLECTIVE BARGAINING UNITS IN THE VILLAGE OF DEERFIELD
WHEREAS, pursuant to Resolution No. R-23-50, the President and Board of Trustees
approved an amendment to the Village Policies and Procedures Manual for non -unionized
employees relative to certain benefits under the Illinois Paid Leave Act; and
WHEREAS, pursuant to Resolution No. R-24-01, the President and Board of Trustees
approved a Paid Family Parental Leave Pilot Program for certain Village employees; and
WHEREAS, both programs were limited in their applicability to employees who are not
covered by either of the Village's two collective bargaining agreements; and
WHEREAS, the Village is under no obligation to extend such benefits to the employees
covered by those collective bargaining agreements until such time as a new round of bargaining
begins in 2026; and
WHEREAS, the President and Board of Trustees have nevertheless determined that
extending these two benefits to the Village employees covered by collective bargaining
agreements prior to the next round of bargaining is reasonable and will promote the overall quality
of the Village's work environment; and
WHEREAS, to that end, Village staff has prepared, and both unions have agreed to, the
Mid -Term Agreements attached to this Resolution;

NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
in the exercise of its home rule powers, as follows:
SECTION 1: Mid -Term A reement Approved Illinois Council of Police). The
President and Board of Trustees hereby approve of a Mid -Term Agreement with the Illinois
Council of Police substantially in the form of Exhibit 1 attached hereto and made a part hereof.
SECTION 2: Mid -Term Agreement Aimroved International Union of Operatinp.
Engineers Local 150). The President and Board of Trustees hereby approve of a Mid -Term
Agreement with the International Union of Operating Engineers Local 150 substantially in the
form of Exhibit 2 attached hereto and made a part hereof.
SECTION 3: Home Rule. That this Resolution, and each of its terms, shall be the
effective legislative act of a home rule municipality without regard to whether such Resolution
should: (a) contain terms contrary to the provisions of current or subsequent non -preemptive state
law; or (b) legislate in a manner or regarding a matter not delegated to municipalities by state law.
It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the
terms of this Resolution should be inconsistent with any non -preemptive state law, this Resolution
shall supersede state law in that regard within its jurisdiction.
SECTION 4: Effective Date. That this Resolution shall be in full force and effect from
and after its passage and approval as provided by law.

MID-TERM AGREEMENT

MID-TERM AGREEMENT
THIS MID-TERM AGREEMENT is hereby agreed to by and between the Village of
Deerfield and the Illinois Council of Police as follows:
Section 1. Amendment. Section 13.1 of the parties' collective bargaining agreement,
"Holiday List," is hereby amended to provide as follows (new language shown in redline):
Section 13.1. Ho/Ida LiSt. Official holidays recognized by
Deerfield for officers are as follows:
New Year's Day Labor Day
President's Day Columbus Day
Veteran's Day Thanksgiving Day
Memorial Day Christmas Day
Independence Day Five Floating Holidays
Section 2. Paid Family Parental Leave Pilot Program. The "Paid Family Parental
Leave Pilot Program" approved by the President and Board of Trustees of the Village of Deerfield
pursuant to Resolution R-24-01 will be made available to bargaining unit members. The Union
understands that this Pilot Program may sunset, at which point it will no longer be available to
bargaining unit members. For reference purposes, a copy of Resolution R-24-01 and the Pilot
Program are attached to this Agreement. Leaves taken by bargaining unit members Malddnado
(11-3-23 through 1-29-24) and Schroeder (11-14-23 through 12-29-23) will be retroactively
covered by the pilot program.
Section 3. All Other Terms. All other terms of the parties' collective bargaining
agreement remain in full force and effect. This amendment is not precedent setting.

(International Union of Operating Engineers Local 150)
MID-TERM AGREEMENT
THIS MID-TERM AGREEMENT is hereby agreed to by and between the Village of
Deerfield and the International Union of Operating Engineers Local 150 as follows:
Section 1. Amendment. Section 12.3 of the parties' collective bargaining agreement,
"Funeral Leave," is hereby amended to provide as follows (new language pAderinec}:
SECTION 12.3: FUNERAL LEAVE
Employees may, upon the recommendation and at the discretion of the
Department Head and with the approval of the Village Manager, be granted up to
three (3) days with pay to attend the funeral of any of the following relatives:
spouse, parent, child, stepchild, sibling, father/mother-in-law, grandparents,
spouse's grandparents, or any other relative living in the same household with the
employee. This leave may be extended up to a total of five (5) days with the prior
approval of the Village Manager. Time allowed in each circumstance is governed
by the immediacy of the relative and the distance to be traveled to attend the funeral,
among other considerations. Requests for funeral leave will be considered as soon
as possible following notice of the bereavement.

Five Floating Personal Days
Employees will be paid for the holiday only if they are in an approved pay
status the scheduled day before and the day following the holiday. Floating personal
days may only be used with the prior approval of the employee's supervisor.
Section 2. Paid Familv Parental Leave Pilot Program. The "Paid Family Parental
Leave Pilot Program" approved by the President and Board of Trustees of the Village of Deerfield
pursuant to Resolution R-24-01 will be made available to bargaining unit members. The Union
understands that this Pilot Program may sunset, at which point it will no longer be available to
