ORDINANCE NO. 0 -91 -02 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1975 AND AUTHORIZING THE USE OF COMPLIANCE TICKETS FOR ORDINANCE VIOLATIONS WHEREAS, the Village of Deerfield recognizes the volume of cases in the judicial system with respect to certain ordinance violations; and WHEREAS, it is in the best interest of the Village to provide relief for the judicial system and to facilitate the disposition of certain cases involving minor ordinance violations for the convenience of the offender and to more efficiently achieve compliance with all laws of the Village. NOW, THEREFORE, be it ordained by the Mayor and Board of Trustees of the Village of Deerfield, Lake and Cook Counties, Illinois as follows: SECTION That Section 1 -25 of Chapter 1 of the Municipal ONE: Code of Deerfield of 1975, as amended, be and is hereby further amended by adding thereto subsection (g) as follows: "(g) Compliance Tickets may be issued for violations of the Municipal Code and Zoning Ordinance in accordance with the provisions and procedures set forth in Chapter 22 of the Municipal Code and the Zoning Ordinance." SECTION That Article 20 of Chapter 22 of the Municipal TWO: Code of Deerfield of 1975, as amended, be and is hereby further amended by adding thereto Section 22 -160A as follows: "(a) For purposes hereof the following definitions shall apply: (1) Compliance Tickets are herewith defined as tickets which may be issued for Ordinance Violations in lieu of a citation or arrest warrant for the violation. ORDINANCE NO. 0 -91 -02 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1975 AND AUTHORIZING THE USE OF COMPLIANCE TICKETS FOR ORDINANCE VIOLATIONS (2) Village Officer or Agent is herewith defined as any Village police officer, code enforcement officer and any other officer authorized by the Municipal Code of the Zoning Ordinance of the Village of Deerfield to issue arrest warrants or citations. (b) At the discretion of the Village Officer or Agent, a person accused of an Ordinance Violation may be issued a Compliance Ticket in lieu of a citation or arrest warrant for the violation. (c) A Compliance Ticket must be settled by paying to the Village in accordance with the restrictions provided on the Compliance Ticket an administration fee in the amount of $25.00 within 10 days of the date of issuance. In the event payment of the $25.00 administration fee has not been obtained within said 10 day period, the administration fee will be increased to $50.00 for the period beginning the 11th day and including the 30th day after issuance of the Compliance Ticket and the offender shall have until the close of business on the 30th day after issuance to pay the increased fee. After the 30th day the Village shall determine whether a notice of appearance will be issued or the past due fee will be referred for collection or whether payment of the fine will remain acceptable. (d) If the offender does not settle the claim including both payment of the administration fee and compliance, where required, the Village may use other legal remedies including, but not limited to, the issuance of a criminal complaint, the issuance of a notice to appear in court or the referral to a collection agency for said violation and the offender shall be subject to the fines and penalties set forth in the applicable provisions of the Municipal Code." ORDINANCE NO. 0- 91-02 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1975 AND AUTHORIZING THE USE OF COMPLIANCE TICKETS FOR ORDINANCE VIOLATIONS SECTION That the Village Clerk is hereby directed to THREE: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and FOUR: effect from and after its passage, approval and publication, as provided by law.
