O-24-08VILLAGE OF DEERFIELD ORDINANCE NO. 2024- 0-24-08 AN ORDINANCE AMENDING SECTION 9.03-C OF "THE DEERFIELD ZONING ORDINANCE 1978," AS AMENDED, REGARDING CONSTRUCTION, DEMOLITION, AND RESTAURANT DRIVE-THRU MENU BOARD SIGNS WHEREAS, the Village of Deerfield is a home rule municipal corporation in accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs; and WHEREAS, Section 9.03-C of the "The Deerfield Zoning Ordinance 1978," as amended ("Zoning Ordinance', sets forth regulations that govern the posting of temporary construction signs ("Construction Sign Regulations'); and WHEREAS, Section 9.02-B of the Zoning Ordinance sets forth regulations that govern the posting of Drive-Thru Menu Board Signs in the C-2 Outlying Commercial District ("Menu Board Sign Regulations') (the Construction Sign Regulations and Menu Board Sign Regulations are, collectively, the "Sign Regulations'); and WHEREAS, the Village desires to amend the Sign Regulations to keep them consistent with the regulations in the Village's building regulations and make the approval process for menu board signs more efficient ("Proposed Amendments'); and WHEREAS, a public hearing by the Plan Commission to consider the Proposed Amendments to the Zoning Ordinance was duly advertised on December 21, 2023, in the Deerfield Review, and was held on January 11, 2024; and WHEREAS, on January 11, 2024, the Plan Commission approved findings of fact in support of the Proposed Amendments, in accordance with and pursuant to Section 13.10 of the Zoning Ordinance, and voted to recommend approval of the Proposed Amendments by the Village Board; and WHEREAS, the Village Board has considered the standards for amendments set forth in Section 13.10 of the Zoning Ordinance; and WHEREAS, the President and Board of Trustees have determined that it will serve and be in the best interests of the Village to adopt the Proposed Amendment of the Zoning Ordinance pursuant to this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. 1 4856-1032-4884, v. 1 SECTION TWO: AMENDMENT TO SECTION 9.03-C OF THE ZONING ORDINANCE. Section 9.03-C titled "Construction Signs," of Article 9, titled "Signs," of the Zoning Ordinance is hereby amended and shall read as follows: "9.03-C Construction Signs 3. Construction and Demolition Signs Required by Building Reiulations Construction and demolition sins required by Section 6-70(c of the Village Code are permitted and shall not count against the limitation on the number of construction signs allowed by this Section All construction and demolition signs required by Section 6-70(c) must comply with all of the regulations contained in Section 6-70(c) and this Section." SECTION THREE: AMENDMENT TO SECTION 9.02-B OF THE ZONING ORDINANCE:, Section 9.02-13 titled "Commercial Districts," of Article 9, titled "Signs," of the Zoning Ordinance is hereby amended and shall read as follows: "9.02-B Commercial Districts In all Commercial Districts, only the following signs are permitted and then only if accessory and incidental to a permitted or Special Use in such districts: 14. Restaurant Drive-Thru Menu Board Signage in the C-2 Outh ins Commercial District a. Number. Area, Location, Height and Lighting. The number, area, location, height and lighting of a restaurant drive- thru menu board sign shall be determined by the Corporate Authorities V411 ge plan- r^----miss ^'^ Appearance Review Commission. SECTION FOUR: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FIVE: EFFECTIVE DATE. This Ordinance will be in full force and effect from and after its passage and approval in the manner provided by law.
