ORDINANCE NO. 2024- 0-94-06
AN ORDINANCE AMENDING SECTIONS 2.00, 2.00-E, 2.00-H AND 12.08-D OF "THE
DEERFIELD ZONING ORDINANCE 1978," AS AMENDED, TO REQUIRE
PLANNED UNIT DEVELOPMENT APPROVAL OF DEVELOPMENTS
TWO ACRES OR MORE, AND TO ADDRESS MULTIPLE BUILDINGS AND
PRINICIPAL USES ON ZONING LOTS
WHEREAS, the Village of Deerfield is a home rule municipal corporation in
accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970;
and
WHEREAS, the Village has the authority to adopt ordinances and to promulgate
rules and regulations that pertain to its government and affairs; and
WHEREAS, large developments and use of zoning lots for more than one building or
principal use may have significant impacts on the Village and neighboring properties; and
WHERAS, Article 2 of the "The Deerfield Zoning Ordinance 1978," as amended
("Zoning Ordinance'), sets forth the generally applicable provisions that govern
development in all of the Village's Zoning Districts and, among other things, govern multiple
principal buildings and uses located on a single zoning lot ("General Regulations'); and
WHEREAS, Article 12 of Zoning Ordinance establishes, among other things,
regulations regarding planned unit developments within the Village ("PUD Regulations');
and
WHEREAS, the General Regulations and PUD regulations are intended to encourage
creative, imaginative and desirable approach to certain residential, commercial and
industrial developments, while also setting forth restrictions for large or more complex land
uses that protect the Village, its businesses, and residents from incompatible or injurious
land uses; and
WHEREAS, the Village desires to amend the General Regulations and PUD
regulations to more effectively regulate and govern large developments and developments
that include more than one principal building or use on a zoning lot ("Proposed
Amendments'); and
WHEREAS, a public hearing by the Plan Commission to consider the Proposed
Amendments to the Zoning Ordinance was duly advertised on December 21, 2023, in the
Deerfield Review, and was held on January 11, 2024; and
WHEREAS, on January 11, 2024, the Plan Commission approved findings of fact in
support of the Proposed Amendments, in accordance with and pursuant to Section 13.10 of
the Zoning Ordinance, and voted to recommend approval of the Proposed Amendments by
the Village Board; and

WHEREAS, the Village Board has considered the standards for amendments set
forth in Section 13.10 of the Zoning Ordinance; and
WHEREAS, the President and Board of Trustees have determined that it will serve
and be in the best interests of the Village to adopt the Proposed Amendment of the Zoning
Ordinance pursuant to this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: AMENDMENT TO SECTION 2.00-E OF THE ZONING
ORDINANCE. Section 2.00-E, titled "Number of Buildings on a Zoning Lot," of Article 2,
titled "General Provisions," of the Zoning Ordinance is hereby amended to read as follows:
"2.00-E Number of Buildings on a Zoning Lot
Not more than one {11} principal detached building shall be located on any
met ZoningWit, except in the case of Planned Unit Developments and
Multiple Use Unified Developments."
SECTION THREE: AMENDMENT TO SECTION 2.00-H OF THE ZONING
ORDINANCE. Section 2.00-H, titled "Number of Principal Uses on a Zoning Lot," of Article
2, titled "General Provisions," of the Zoning Ordinance is hereby amended to read as follows:
"2.00-H Number of Principal Uses on a Zoning Lot
Not more than one principal use shall be permitted on a met Zoning Lot
unless otherwise provided for in this Ordinance."
SECTION FOUR: AMENDMENT TO ARTICLE 2 OF THE ZONING
ORDINANCE TO ADOPT A NEW SECTION 2.00-K. Article 2, titled "General
Provisions," of the Zoning Ordinance is hereby amended to add a new Section 2.00-K, which
shall be and read as follows:
"2 00-K Developments of ZoningLots of Two Acres antl Over to be
Developed -as a Planned Unit Devel m n s
No zoning lot that is two acres or more may be developed in the Village
except on the a rova 1._a ned unit development 1jursuant to
the procedures and requirements of Article 12 of the Zoning
Ordinance."
SECTION FIVE: AMENDMENT TO SECTION 12.08-D OF THE ZONING
ORDINANCE. Section 12.08-D, titled, "Minimum Size of Site," of Article 12, titled "Planned

Unit Developments and Planned Residential Developments," is hereby amended to read as
follows:
"12.08-D Minimum Size of Site
A minimum gross area of five -(a) two acres shall be required of each site for
consideration of an Industrial Planned Unit Development.
SECTION SIX: PUBLICATION. The Village Clerk is hereby directed to publish
this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION SEVEN: EFFECTIVE DATE. This Ordinance will be in full force and
effect from and after its passage and approval in the manner provided by law.
