R-23-60VILLAGE OF DEERFIELD RESOLUTION NO. R-23-60 A RESOLUTION WAIVING COMPETITIVE BIDDING AND APPROVING AN AGREEMENT WITH AXON ENTERPRISE, INC. FOR BODY CAMERAS AND RELATED EQUIPMENT AND SOFTWARE WHEREAS, the Village of Deerfield ("Village') is a home rule municipality in accordance with Article VII, Section 6 of the Constitution of the State of Illinois of 1970; and WHEREAS, pursuant to the Law Enforcement Officer -Worn Body Camera Act, 50 ILCS 706/10-1 et seq. ("Act'), the Village is required to have its police officers use body cameras by January 1, 2025; and WHEREAS, to comply with the Act, the Village desires to purchase body cameras and ancillary equipment and software for the Police Department (collectively, `Body Cameras'); and WHEREAS, Axon Enterprise, Inc. ("Axon') submitted a proposal to provide the Village Body Cameras; and WHEREAS, the Village desires to enter into an agreement with Axon for the procurement of Body Cameras for a term of 60 months in the amount not to exceed $370,661.72.00 ("Agreement'); and WHEREAS, the Mayor and Board of Trustees have determined that waiving bidding and entering into the Agreement with Axon to provide Body Cameras will serve and be in the best interest of the Village and its residents; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE BOARD OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Resolution as findings of the Village Board. SECTION TWO: WAIVER OF COMPETITIVE BIDDING REQUIREMENT. Pursuant to Section 9-16 of the Village Code and the Village's home rule authority, the Village Board waives the requirement of competitive bidding for the Body Cameras. SECTION THREE: APPROVAL OF AGREEMENT. The Agreement by and between the Village and Axon is hereby approved in substantially the form attached to this Resolution as Exhibit A, and in a final form and substance acceptable to the Village Manager and the Village Attorney. SECTION FOUR: AUTHORIZATION TO EXECUTE AGREEMENT. The Mayor and the Village Clerk are hereby authorized and directed to execute and attest, on behalf of the Village, the final Agreement upon receipt by the Village Clerk of at least one original copy of the final Agreement executed by Axon; provided, however, that if the executed 4871-8102-9013, v. 2 copy of the final Agreement is not received by the Village Clerk within 60 days after the effective date of this Resolution, then this authority to execute and attest will, at the option of the Mayor and Board of Trustees, be null and void. SECTION FIVE: EFFECTIVE DATE. This Resolution shall be in full force and effect from and after its passage, by a vote of two-thirds of the Village Board, and approval in the manner provided by law. On December 18, 2023, at the regularly scheduled meeting of the Mayor and Board of Trustees, the Police Department will be seeking approval of a resolution authorizing the Police Department to purchase forty-three (43) Body Worn Cameras, related software, and hardware from Axon Enterprise Inc. HISTORY Pursuant to the Illinois Safe -T Act, enacted in July of 2023 by Illinois Legislators, the Deerfield Police Department will be required to implement the use of Body Worn Camera's for its' Officers by January 1, 2025. The Deerfield Police Department recognizes that trust and mutual respect between the Department and our community is imperative. The ability to protect and serve with integrity is essential to our criminal justice system. The use of Body Worn Cameras will assist in our ability to continue to provide service in a manner as described above. Officer -worn body cameras will provide state of the art evidence collection and provide additional opportunities for training and instruction. Furthermore, the body worn cameras may provide impartial evidence and documentation to settle disputes and allegations of misconduct. The evidence collected while improving transparency and accountability will strengthen the already high public trust. To comply with the mandated State requirements, the Department is seeking to purchase Body Worn Cameras in the first quarter of 2024 and begin a pilot program to familiarize officers and administration with the operation of the equipment and software required to run the equipment with full compliance by the established deadline. The Department is seeking authorization to purchase the necessary equipment and a waiver of the competitive bidding process, specifically the AXON Body3 camera, from Axon Enterprise, Inc. for several reasons including the following; Axon Enterprise Inc. is listed on the National Association of State Procurement Officials for the AXON Body3 body worn cameras. In addition, Axon is the sole source of the Body3 body worn cameras for which provides Multi-mic Audio (four built-in microphones), Gunshot detection and alerts, find my camera feature, and up to 120 second buffering period to record footage before pressing record button. Additionally, the Lake County States Attorney's office also only accepts digital evidence through Evidence.com, as supplied by AXON, which is the sole storage location for the body worn cameras. The sharing of this evidence electronically will save costs in preparing other media options for the prosecution of cases. AXON Enterprise is also the vendor the Department is seeking approval on for the AXON Interview cameras which will store data on the same service of Evidence.com. Looking into the future the Department will also be looking to purchase new squad car camera systems through AXON with the 2025 fleet.
