11/20/2023November 20, 2023 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order on November 20, 2023, at 7:30 p.m. at Deerfield Village Hall. The clerk called the roll and announced that the following were Present: Robert Benton Larry Berg Elaine Jacoby Rebekah Metts-Childers Mary Oppenheim William Seiden Absent: Dan Shapiro, Mayor and that a quorum was present and in attendance. Also present were Village Manager Kent Street and Ben Schuster, Village Attorney. TEMPORARY CHAIRPERSON In the absence of Mayor Shapiro, Trustee Seiden moved to nominate Trustee Metts-Childers as Temporary Chairperson. Trustee Jacoby seconded the motion. The motion passed by the following vote: AYES: Benton, Berg, Jacoby, Metts-Childers, Oppenheim, Seiden (6) NAYS: None (0) PLEDGE OF ALLEGIANCE Temporary Chairperson Metts-Childers led those in attendance in reciting the Pledge of Allegiance. DEPARTMENTAL OBJECTIVES Finance Director Eric Burk presented highlights from the Finance Department's six-month report. Mr. Burk reported the Village received GFOA Certificate of Excellence in Financial Reporting and a clean audit. He noted the shortage of employees is now affecting accounting, which is driving up pricing and causing delays. Mr. Burk reported the Village is under contract with Baker Tilly until 2026, so it is not an immediate issue. He stated the Village received notice that the 2023 budget qualified for the GFOA award. Mr. Burk reported the regular vehicle sticker sale has been completed, and that stickers are still available at Village Hall. He noted the Village received $1.6 million in interest income which is up from $400,000 last year. Mr. Burk reported the actuarial valuation for the police pension contribution has been completed. He noted the required debt service payments have been made. Mr. Burk reported the spend down for the 2021 bond proceeds was completed and additional interest income was received. Mr. Burk noted no new debt is expected in 2023 or 2024. He reported the Village has maintained a AAA rating, which is the highest rating possible. Mr. Burk noted an annual compensation study was completed by HR, as well as a wellness program. He reported the Village completed a number of projects including improving utility billing. Trustee Benton seconded the motion. The motion passed unanimously on a voice vote. BILLS AND PAYROLL Trustee Seiden moved to approve the bills and payroll dated November 20, 2023. Trustee Oppenheim seconded the motion. He noted there was a tremendous disparity in the average front yard setback on the street, they wanted to save as many trees as possible, and they wanted to keep the structure away from the golf course. Trustee Oppenheim noted this property has been vacant for a long time. Trustee Seiden asked if any neighbors complained about the request. Mr. Bernstein stated one neighbor came to the Hearing in favor of the request, and that no complaints were received. Trustee Oppenheim moved to accept the report and recommendation of the Board of Zoning Appeals concerning relief from Article 2.02-D,1, of the Deerfield Zoning Ordinance for the property located at 560 Brierhill Road and direct the Village Attorney to prepare the Ordinance. Trustee Berg seconded the motion. The motion passed by the following vote: AYES: Benton, Berg, Jacoby, Metts-Childers, Oppenheim, Seiden (6) NAYS: None (0) OLD BUSINESS ORDINANCE 0-23-33 ADOPTING THE An Ordinance adopting the 2024 budget for the BUDGET FOR THE VILLAGE OF Village of Deerfield as discussed at the Committee DEERFIELD FOR THE FISCAL YEAR of the Whole meetings on September 26, 2023, and BEGINNING JANUARY 1, 2024, AND October 2, 2023. Changes were discussed at the ENDING DECEMBER 31 2024 Executive Session on November 6, 2023. Mr. Burk has not received any public comment since the November 6, 2023, meeting. Trustee Benton moved to adopt the Ordinance adopting the fiscal year 2024 budget for the Village of Deerfield. Trustee Oppenheim seconded the motion. FISCAL YEAR 2024 Mr. Burk noted this is reflected in the budget. Trustee Oppenheim moved to adopt the Resolution adopting the fiscal year 2024 consolidated fee schedule. AND EMPLOYEES FOR THE FISCAL YEAR 2024 FOR THE VILLAGE OF DEERFIELD Mr. Burk noted the changes were developed and discussed as part of the budget. Trustee Benton moved to adopt the Ordinance amending the Village of Deerfield wage and salary plan and establishing the compensation of officers and employees for the fiscal year 2024 for the Village of Deerfield. Trustee Oppenheim seconded the motion. The motion passed by the following vote: AYES: Benton, Berg, Jacoby, Metts-Childers, Oppenheim, Seiden (6) NAYS: None (0) NEW BUSINESS PUBLIC HEARING ON THE PROPOSED 2023 TAX LEVY Trustee Berg moved to open the Public Hearing. Trustee Benton seconded the motion. The motion passed on a voice vote. Mr. Burk reported the amount of the 2023 tax levy was developed during the 2024 budget process. He noted the total levy, as indicated in the budget, required by bond ordinances, and Board of Trustees meeting November 20, 2023 Page 5 of 8 requested and approved by the library, is $14,079,371. Mr. Burk stated this is the pre -abatement number. He reported debt service abatements total $359,239 and bring the net levy to $13,720,132. Trustee Oppenheim is comforted by keeping the taxes low, as a $500,000 home will have a tax increase of $20. Trustee Oppenheim moved to close the Public Hearing. Trustee Benton seconded the motion. The motion passed unanimously on a voice vote. RESOLUTION R-23-46 TO APPROVE Assistant Director of Public Works and Engineering THE JK WILMOT SUBDIVISION Tyler Dickinson reported that as part of the 2016 IMPROVEMENTS Samantha's Way subdivision agreement, the Village and HOA are both to assume improvements at the conclusion of this project. Mr. Dickinson noted the Village would assume maintenance of the roadway, sidewalk, street lighting, water main, and sanitary sewer. He reported the HOA would mainly assume the maintenance responsibilities of the storm water considerations located outside of the Village right-of-way, including storm sewers, structures, and appropriate grading, as well as the private landscaping within the Wilmot Road right-of-way. Trustee Oppenheim moved approve the JK Wilmot subdivision improvements. Trustee Berg seconded the motion. Country Lane from Pine Street to west limits (0.2 miles) 2. Gordon Terrace from Birchwood Ave to Willow Ave (0.25 miles) 3. Burr Oak entire limits (0.25 miles) 4. Rosewood Avenue from Fairview Ave to Willow Ave (0.1 miles) 5. Mallard Lane from Central Ave to south limits (0.2 miles) 6.Orchard Lane from Waukegan Road to Rosemary Terrace (0.1 miles) 7. Millstone Road from Carriage Way to Smoke Tree Road (0.2 miles) 8. Shag Bark Lane from Millstone Road to Carriage Way (0.1 miles) 9. Fox Hunt Trail from Millstone Road to Carriage Way (0.2 miles) 10. Smoke Tree Road from Millstone Road to Carriage Way (0.2 miles) The scope of work includes pavement removal and replacement, curb and gutter removal and replacement, sidewalk removal and replacement, storm sewer improvements, adjustment of structures and parkway restoration. The total budgeted amount for the project this year, Board of Trustees meeting November 20. 2023 Page 6 of 8 including $2,750,000 in MFT and $1,240,000 in Rebuild Illinois Grants is $3,990,000. There is no local share proposed for next year's project. Mr. Street reported this is paid by gas tax. Trustee Oppenheim questioned whether these funds need to be spent during 2024. Mr. Dickinson noted the Village will scale back if the bids come in too high. Trustee Jacoby moved to accept the Resolution for the 2024 MFT Street Rehabilitation Project in an amount not to exceed $2,750,000. Trustee Benton seconded the motion. Mr. Street commended Governor Pritzker and Deerfield's local representatives for their support with the Rebuild Illinois grants. Trustee Oppenheim moved to accept the Resolution for the 2024 Rebuild Illinois Street Rehabilitation Project in an amount not to exceed $1,240,000. Trustee Berg seconded the motion. The motion passed by the following vote: AYES: Benton, Berg, Jacoby, Metts-Childers, Oppenheim, Seiden (6) NAYS: None (0) Board of Trustees meeting November 20, 2023 Page 7 of 8 RESOLUTION R-23-49 APPROVING A Resolution waiving the competitive bidding and THE WAIVER OF COMPETITIVE authorizing the purchase of ten police vehicles from BIDDING AND THE PURCHASE OF Highland Park Ford and emergency equipment from TEN POLICE VEHICLES FROM Havey Communications. The ten vehicles will cost HIGHLAND PARK FORD AND an estimated $500,000 and the equipment will cost EMERGENCY EQUIPMENT FROM an estimated $150,000. HAVEY COMMUNICATIONS Deputy Chief Fry noted Ford has notified him the order would have to be made before the end of the year for delivery in 2025. He also asked Ford about the possibility of obtaining hybrid vehicles, but was told it would not be feasible. Trustee Seiden asked why the Village did not conduct competitive bidding. Deputy Chief Fry noted Highland Park Ford has been the low bidder in the past and these are estimated costs. Trustee Oppenheim moved to accept the Resolution waiving the competitive bidding and authorizing the purchase of ten police vehicles from Highland Park Ford and emergency equipment from Havey Communications at the approximate cost not to exceed $650,000. Trustee Seiden seconded the motion. The motion passed by the following vote: AYES: Benton, Berg, Jacoby, Metts-Childers, Oppenheim, Seiden (6) NAYS: None (0) ORDINANCE 0-23-35 INCREASING An Ordinance increasing the number of sergeants THE NUMBER OF SERGEANTS AND and patrol officers in the Deerfield Police PATROL OFFICERS IN THE Department. Deputy Chief Budny noted this DEERFIELD POLICE DEPARTMENT increase would result in one Chief of Police, 12 sergeants, and 30 patrol officers, resulting in 43 sworn personnel rather than 42 sworn personnel. He reported there has only been one increase over the past 20 years, outside of the school resource officers. Deputy Chief Budny noted the new housing developments, task force participation, training, and technology requirements have made it necessary to increase the department staff. Trustee Seiden moved to adopt the Ordinance increasing the number of sergeants and patrol officers in the Deerfield Police Department. Trustee Oppenheim seconded the motion. The motion passed by the following vote: AYES: Benton, Berg, Jacoby, Metts-Childers, Oppenheim, Seiden (6) NAYS: None (0) DISCUSSION ECUMENICAL SERVICE Trustee Oppenheim reported the ecumenical service at the Presbyterian Church was lovely. Trustee Board of Trustees meeting November 20, 2023 Page 8 of 8 Benton and Highland Park Mayor Nancy Rotering spoke. Trustee Benton added the high school choir and orchestra were there, as well as the church choirs. DOWNTOWN TREE LIGHTING Mr. Street reported the downtown tree lighting ceremony will take place on Wednesday, November 22, 2023, from 4-5 p.m. at the Village Center. WINTER CELEBRATION Winter Celebration will take place on Friday, December 1, 2023, from 5-8 p.m. at Village Hall. WINTER MARKET Winter Market will take place on Saturday, December 2, 2023, from 9 a.m. to 2 p.m. at the Patty Turner Center. BOARDS AND COMMISSION The Board and Commissions Reception will take RECEPTION place on Sunday, December 3, 2023, from 3-6 p.m. in the Solarium at 570 Lake Cook Road.
