R-23-43VILLAGE OF DEERFIELD RESOLUTION NO. 2023- R-23-43 A RESOLUTION APPROVING THE PURCHASE OF ONE MT-7 TRACKLESS VEHICLE FROM EJ EQUIPMENT WHEREAS, the Village of Deerfield ("Village') is a home rule municipality in accordance with Article VII, Section 6 of the Constitution of the State of Illinois of 1970; and WHEREAS, he Village Board conceptually approved the recommendations of staff with respect to the purchase of Public Works Equipment, noting that difficulties with supply chain for certain pieces of equipment is causing a ripple effect throughout the industry; and WHEREAS, the Village Staff has identified the need to purchase one MT-7 Trackless Vehicle from EJ Equipment ("Vehicle'); and WHEREAS, the Village has been notified by the manufacturer that a single vehicle is available for delivery after January 1 of 2024 through EJ Equipment in Manteno, Illinois ("Vendor'); and WHEREAS, the vehicle falls within the replacement schedule as outlined in the Vehicle Equipment Replacement Fund by the Village; and WHEREAS, the Village Board has determined that it will serve and be in the best interest of the Village and its residents to approve the purchase by the Village of the Vehicle, from the Vendor for the amount of $159,687.05.; and WHEREAS, pursuant to Section 9-16 the "Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("Village Code', the bidding requirements may be waived for contracts for supplies and services available from a single source or, which by their nature, are not adaptable to competitive bidding; and WHEREAS, the Village Board has determined that waiving bidding for the Vehicle and approving the purchase from the Venfor will serve and be in the best interest of the Village and its residents; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION 1: RECITALS. The Village Board hereby adopts the foregoing recitals as its findings, as if fully set forth herein. SECTION 2: WAIVER OF COMPETITIVE BIDDING. Pursuant to Section 9-16 of the Village Code and the Village's home rule authority, the Village Board waives the requirement of competitive bidding for the procurement of the Vehicle. SECTION 3: RATIFICATION OF PURCHASE FROM RAYMOND. The Village Board hereby ratifies the purchase from EJ Equipment for MT-7 Trackless Vehicle in an amount of $159,687.05. SECTION 4: AUTHORIZATION TO EXECUTE CONTRACT. The Mayor and the Village Clerk are hereby authorized and directed to execute and attest, on behalf of the Village, all documents necessary to complete the purchase approved pursuant to Section 3 of this Resolution, and the Village Board acknowledges, ratifies, and approves the prior execution of any such documents. SECTION 5: EFFECTIVE DATE. This Resolution shall be in full force and effect from and after its passage and approval by the vote of two-thirds of the Trustees.
