O-90-36ORDINANCE NO. 0 -90 -36 AN ORDINANCE AMENDING PORTIONS OF ARTICLE 5 and 14 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Corporate Authorities of the Village of Deerfield ( "Applicant ") to consider certain text amendments to the Zoning Ordinance of the Village of Deerfield relative to the definitions of the terms Planned Unit Development, Shopping Center /Planned Unit Development, and Use and to the listing of Shopping Center /Planned Unit Development as a Special Use in the C -1 Village Center District and in the C -2 Outlying Commercial District; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact and recommended a text amendment to the Zoning Ordinance of the Village of Deerfield to achieve the objectives sought by the Applicant; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the recommendation of the Plan Commission as modified in the manner hereinafter set forth, will serve the best interests of the Village of Deerfield. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS; SECTION That Articles 5.02 -C and Article 14 of the Zoning ONE Ordinance of the Village of Deerfield as amended, and the same is further amended by the following: Article 14 Definitions The existing definition of "Planned .Unit Development" is hereby deleted in its entirety and the following definition is added: Planned Unit Development: An area of 'a minimum size, as specified by the Zoning Ordinance, to be planned, developed, operated, and maintained as a single entity under unified ownership or control, containing one or more principal buildings to accommodate one or more permitted uses or special uses as allowed by the underlying zoning district provisions, and appurtenant common areas and other accessory uses incidental to the principal uses as controlled by the underlying district provisions. Said development may be subdivided or resubdivided pursuant to Article 12.01 -B. 1 ORDINANCE NO. 0 -90 -36 AN ORDINANCE AMENDING PORTIONS OF ARTICLES 5 and 14 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD Article 14 is further amended so as to include the following definition of Shopping Center /Planned Unit Development: Shopping Center /Planned Unit Development: A Planned Unit Development containing one or more buildings which contain one or more permitted or special uses as allowed under the zoning provisions of the zoning district in which the development is located. Not less than fifty (50) percent of the leasable square footage within the building within the development shall be devoted to retail business uses. Article 14 is further amended by adding the following to the existing definition of "Use ": Each business entity, occupancy or tenancy shall be deemed a single use. Two or more business entities, offices, businesses, occupancies or tenancies sharing•a single building or tenant space shall be deemed two or more uses. In those instances where a single business is operating as more than one business entity, the Director of Community Development shall determine whether or not the use will be deemed a single use. Article 5.01 -C is hereby amended by adding "Shopping Center /Planned Unit Development" as Art. 5.01- C,2,j, and the existing "j" and, "k" are hereby renumbered "k ". and 111" respectively. Article 5.02 -C is hereby amended by adding "Shopping Center /Planned Unit Development as Art. 5.02 -C,9 and the existing 11911, 111011, 111111, and 1112" are hereby renumbered 111011, "11", 111211, and 1113" respectively. 2 ORDINANCE NO. 0 -90 -36 AN ORDINANCE AMENDING PORTIONS OF ARTICLES 5 and 14 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD SECTION That the Village Clerk is hereby directed to TWO publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and THREE effect from and after its passage, approval and publication as provided by law.
