O-90-34ORDINANCE NO. 0 -90 -34 AN ORDINANCE AMENDING PORTIONS OF ARTICLE 9 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Library District of the Village of Deerfield ( "Applicant ") to consider certain text amendments to the Zoning Ordinance of the Village of Deerfield relative to P -1 Public Lands District; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact and recommended a text amendment to the Zoning Ordinance of the Village of Deerfield to achieve the objectives sought by the Applicant; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the recommendation of the Plan Commission as modified in the manner hereinafter set forth, will serve the best interests of the Village of Deerfield. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS; SECTION That Article 9 of the Zoning Ordinance of the ONE Village of Deerfield as amended and same is further amended by adding the following: Article 9.02 -E Public Lands District The unique nature of the Public .Lands District is reflected in the types of uses allowed in the District, location of such properties in the midst of the residential, commercial and industrial district and the need for the provision of public facilities. Because of this uniqueness, signage in the Public Lands District should be appropriate for the area in which the property is located, should be sensitive to the neighboring land uses, and should serve the public adequately. Any signage accessory to a use in the Public Lands District should be restricted to that which is necessary to serve the public, taking into consideration the area and land uses most impacted by the signage. Therefore, signs will be permitted and then only if accessory and incidental to a Special Use allowed in the district. Because of the difficulties involved in balancing the need for control of signage and the-need for the provision of information concerning public facilities and public land, such signs as permitted herein may depart from strict conformance with the standards and requirements of this Ordinance. Such 01 ORDINANCE NO. 0 -90 -34 AN ORDINANCE AMENDING PORTIONS OF ARTICLE 9 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD modification of regulations may include other types of signs not specified herein and any such modification shall only be granted upon the approval of the Village Board as an amendment to the property's Special Use Ordinance. All such amendments shall be subject to the procedural requirements for Special-Uses set forth in Article 14, Administration and Enforcement. 1. Identification and Informational Signs, subject to the following: a. Number and Content Because many'of the properties in the Public Lands District are uniquely sized and configured, the number of Informational or Identification signs allowed shall be the minimum number necessary to adequately identify the use of the facility. Such signs may indicate the name and /or address of the use or facility and any appropriate information necessary to adequately inform the public of any restrictions or regulations governing the use or facility. b. Type Said signs maybe ground signs or wall signs. C. Area No sign shall have more than two (2) exposed faces. The maximum gross surface area of a sign face shall be the minimum necessary to adequately present the information thereon. 'Particular consideration will be given to the zoning classification and uses adjacent to the Public Lands property for which the sign is proposed. d. Location (1) Ground signs may be located in any required yard but in no event may they be located closer to a side or front lot line than one half. (1/2) of the minimum setback required in the underlying district regulation. Such signs shall not extend over any lot line and shall take due consideration of traffic safety. (2) Wall signs may be located on any wall of the free standing building where such a sign is deemed appropriate. e. Height (1) Ground signs shall not exceed six (6) feet in height as measured from grade at the bottom of the sign. 2 ORDINANCE NO. 0 -90 -34 AN ORDINANCE AMENDING PORTIONS OF ARTICLE 9 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD (2) Wall signs shall not project higher than the parapet line of the roof of the building. f. Illumination Such signs may not be illuminated unless the public health, safety or general welfare indicates they should be illuminated. SECTION That the Village Clerk is hereby directed to publish TWO this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and ,THREE effect from and after its passage, approval and publication as provided by law.
