O-90-29} JKS01215A2062090/26 ORDINANCE NO. 0 -90- 29 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY, KNOWN AS 849 CENTRAL AVENUE, DEERFIELD, ILLINOIS WHEREAS, Mr. Daniel C. Tranowski, Jr. has petitioned for a variation from the strict provisions of Article 10.2 -1 of the Zoning Ordinance of the village of Deerfield, passed April 17, 1978 as amended, to permit the construction of an addition to an existing non - conforming building while not altering the existing 2.83 foot minimum single side yard which does not meet the required 5 foot minimum and not altering the combined total side yard of 13.39 feet which does not meet the required 14 foot minimum; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees, its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of ONE: the Zoning Board of Appeals are concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and TWO: particular hardships in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property, which is legally described as follows: That part of the South Half of the Northeast Quarter of Section 32, Township 43 North, Range 12, East of the third principal Meridian, described as follows, to -wit: Beginning at a point on the North Line of the South Half of the Northeast Quarter of Section 32 (which point lies 486.6 feet West of the East Line of said Northeast Quarter); running thence West 37.6 feet; thence South ORDINANCE NO. 0 -90 -29 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 849 CENTRAL AVENUE, DEERFIELD, ILLINOIS 255 feet; thence east 37.6 feet; thence North 255 feet to the point of beginning (excepting therefrom a strip of 30 feet wide on the North side thereof) in Lake County, Illinois. SECTION That a variation from the strict provisions of THREE: Article 10.2 -1 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described, is hereby granted so as to permit the construction of an addition to an existing non - conforming building while not altering the existing 2.83 foot minimum single side yard which does not meet the required 5 foot minimum and not altering the combined total side yard of 13.39 feet which does not meet the required 14 foot minimum, all in accordance with the plans presented and filed with the Zoning Board of Appeals. SECTION That the variation hereby granted is subject to FOUR: compliance by the petitioner with all other applicable provisions of the Zoning Ordnance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and FIVE: effect from and after its passage and approval, as provided by law.
