JKS01215A1060790/25 ORDINANCE NO. 0 -90- 26 AN ORDINANCE AMENDING SECTION 22 -167 of ARTICLE 21 OF CHAPTER 22 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1975 BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Section 22 -167 of Article 21 of Chapter 22 ONE: of the Municipal Code of the Village of Deerfield of 1975, entitled "Exhibit G. Fire lanes designated. ", as amended, be and the same is hereby further amended by adding to the list of locations designated as fire lanes, the following: "Marriott Suites Deerfield. A 10' wide lane extending across those portions of the Marriott Suites Deerfield property as more fully described in a certain agreement dated June 4 , 1990, by and between the Village of Deerfield and Marriott Suites Deerfield." SECTION That the Village Clerk is hereby directed to TWO: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and THREE: effect from and after its passage, approval and publication as provided by law. S AGREEMENT THE VILLAGE OF DEERFIELD, a municipal corporation in the State of Illinois (hereinafter referred to as "the'Village "), and Marriott Suites Deerfield (hereinafter referred to as "the Owner "), do hereby covenant and agree, one with the other, THAT: WHEREAS, Owner has the legal right to operate, manage and maintain the parking areas, entrance and access areas associated with the improvements known as Marriott Suites Deerfield, located in the Village of Deerfield; and WHEREAS, parking areas, entrance and access areas for customers of and visitors to MARRIOTT SUITES DEERFIELD are entirely upon the private property of the Owner; and WHEREAS, the constant assurance of immediate ingress and access to all exposures of existing structures by emergency fire and police Vehicles is desirable for the purpose of providing maximum protection of life and property; and WHEREAS, the Municipal Code of-the Village provides the means of establishing and controlling such access assurance through the establishment of fire lanes. NOW, THEREFORE, in consideration of the mutual covenants herein contained, and the reciprocal benefits to the parties, it is agreed as follows: 1. That this Agreement is entered into pursuant to the provisions of Section 11 -209 of Chapter 95 1/2 and Section 1 -1 -7 of Chapter 24, Illinois Revised Statutes, 1987. 2. That the owner requests and authorizes the Village to establish and maintain a fire lane, as depicted on the plat attached hereto as Exhibit A and made a part hereof. 3. That the Village agrees upon execution hereof to add the above described area as an area where stopping, standing or parking of vehicles is prohibited pursuant to 22 -167 of the Municipal Code of Deerfield. 4. That said fire lane area shall be appropriately posted with signage approved by the Village, and the Owner shall pay the cost of said signs and the cost of installation and maintenance thereof. 5. That the Village shall enforce the restrictions against the stopping, standing and parking of vehicles in said fire lane area herein agreed to. 6. That the establishment of said fire lane area and the enforcement of parking restrictions by the Village in no way constitutes a dedication to public use of said fire lane area. 7. That the Village reserves the right to cancel this Agreement at any time. 8. That the Village will cause this Agreement to be promptly recorded with the Recorder of Deeds office at the Owner's expense.
