O-90-20li ORDINANCE NO. 0 -90 -20 AN ORDINANCE AMENDING CHAPTER 12, ARTICLE III OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD Published in pamphlet form this 21st day of May , 1990 by the President and Board of Trustees of Deerfield JKS01215A3051690/12 ORDINANCE NO. 0 -90 -20 AN ORDINANCE AMENDING CHAPTER 12, ARTICLE III OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Section 12.17 (a) of Article III of Chapter ONE: 12 of the Municipal Code of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting subsections (2), (3) and (4) thereof in their entirety and substituting in lieu thereof the following subsections and by adding thereto subsections (5), (6) and (7): "(2) Refuse shall mean all combustible trash, including, but not limited to, paper, cartons, boxes, magazines, excelsior, suitable for deposit in a container as specified under this Article, and non - combustible trash, including, but not limited to, metals, tin cans, glass bottles, crockery, articles of clothing and other mineral and similar waste products suitable for deposit in a refuse container. Refuse shall also include ashes and cinders which must be placed in a disposable tightly covered container." "(3) Garden waste shall mean all yard trimmings, grass, leaves and similar materials suitable for deposit in garden waste containers as specified under this Article. Garden waste shall include those branches and /or brush which can be loosely packed in garden waste containers as specified under this Article." "(4) Miscellaneous waste shall mean all waste materials of a size which render them unsuitable for deposit in a refuse or garden waste container as specified under this Article, including, but not limited to, furniture and appliances." "(5) Residential dwellings shall be defined as single and multi - family dwellings not exceeding two dwelling units." "(6) Recyclable materials shall mean materials which can be removed from refuse and recycled. Included are newsprint, aluminum and other types of cans, glass bottles and other items mutually agreed to by the Village and the scavenger employed by the Village." JKS01215A4051690/13 ORDINANCE NO. 0 -90 -20 AN ORDINANCE AMENDING CHAPTER 12, ARTICLE III OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD "(7) Construction debris shall include, but not be limited to, wood, concrete, lumber and bricks." SECTION That Section 12.18 of Article III of Chapter 12 TWO: of the Municipal Code of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting subsection (d) thereof in its entirety and substituting in lieu thereof, the following subsection and by adding thereto subsection (e): "(d) The types of residential waste as described in this Article shall be collected and removed by the scavenger employed by the Village at the following times: (1) garden waste shall be collected on a weekly basis, (2) miscellaneous waste shall be collected weekly, (3). recyclable materials shall be collected on a weekly basis, (4) garbage and refuse shall be collected twice per week and at a minimum once per week, and (5) construction debris shall be collected upon request of the resident at a fee mutually agreed to by resident and scavenger." "(e) The rates for collection of garbage and refuse shall be seven dollars and eighteen cents ( $. 7.18 ) per month for once a week service, and twelve dollars and forty tix'tents ($ 12.46 ) per month for twice a week service, effe`cti a immediately. The billing for said waste collection shall be made quarterly for the services performed during the preceding period. If the bill for residential waste collection is not paid by the first day of the month following the billing period for which it is rendered, an additional ten percent (10 %) shall be paid as a service charge for said late payment." SECTION That Section 12.19 of Article III of Chapter 12 THREE: of the Municipal Code of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting subsections (a) and (c) thereof in their entirety and substituting in lieu thereof the following subsections and by adding thereto subsections (d) and (e): JKS01215A4051690/14 ORDINANCE NO. 0 -90 -20 AN ORDINANCE AMENDING CHAPTER 12, ARTICLE III OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD "(a) The containers of garbage and refuse as required under Section 12.18 shall be: (1) of a durable metal or plastic material. (2) watertight. (3) Equipped with a tight- fitting cover and with handles suitable for lifting by one man." "(c) Thirty (30) gallon disposable paper bags to be made available by the Village are to be used for garden waste." "(d) Recyclable materials shall be placed in containers approved by the Village." "(e) Only containers complying with these specifications for garbage, refuse, garden waste and recyclable materials respectively may be utilized." SECTION That Section 12.20 of Article III of Chapter 12 FOUR: of the Municipal Code of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting subsections (a) and (b) thereof in their entirety and substituting in lieu thereof, the following subsections: "(a) All containers for garbage shall be kept in the rear of residential dwellings or in the garage where such garage is located at the front of the residence. If the containers are stored in the garage, they must be placed outside the garage for collection." "(b) All garden waste and refuse containers shall be securely closed and placed for collection, along with the container for recyclable materials, at curbside not earlier than sundown of the day preceding the day scheduled for collection from such residence. At curbside shall be defined as follows: (1) residence with conventional curb shall placed containers behind the curb and (2) residence with non - conventional curb shall place containers no closer than two (2) feet nor further than five (5) feet from the parkway adjacent to the pavement." a IV JKS01215A4051690/15 ORDINANCE NO. 0 -90 -20 AN ORDINANCE AMENDING CHAPTER 12, ARTICLE III OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD SECTION That the Village Clerk is hereby directed to FIVE: publish this Ordinance in pamphlet form.
