O-89-41562351080989/85 ORDINANCE NO. 0 -89 -41 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT - PHASE IV Published in pamphlet form this 5th day of September , 1989, by the President and Board of Trustees of Deerfield. 5623S4081689/82 ORDINANCE NO. 0 -89 -41 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT - PHASE IV WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the American National Bank and Trust Company as Trustee of trust No. 62258 dated September 18, 1984, (the "Owner ") and Parkway North Development/ Deerfield Saunders Joint Venture (the "Developer ") (the Owner and the Developer herein jointly referred to as "Applicant ") to authorize an Amendment to Ordinance No. 85 -36 to provide for the development and use of certain real estate described on Exhibit A hereto for a Special Use - Planned Unit Development, under and pursuant to the provisions of Articles 6.1 -3, 5, 12.1, 12.8 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, the President and Board of Trustees have considered and reviewed the Amended Final Development Plan for Phase IV on the Subject Property consisting of the Site Plan and Utility Plan, each prepared by S.D.I. Consultants, Ltd., and dated June 27, 1989 and the Landscaping Plan prepared by Johnson, Johnson and Roy, Inc., dated June 23, 1989 (collectively referred to as the "Amended Final Plan - Phase IV ") and submitted by Applicant to the Plan Commission reflecting all revisions from that portion of the original Master Development Plan relating to Phase IV; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Amendment to Special Use - Industrial Planned Unit Development in accordance with the Amended Final Plan - Phase IV for the Subject Property marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby ONE: affirmatively find that the Amended Special Use - Phase IV, as hereby authorized, fully complies with the requirements and standards set forth in Article 13.11 -4 of the Zoning Ordinance and that the Amended Special Use of the real estate ORDINANCE NO. 0 -89 -41 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT - PHASE IV as and for puroses of an Industrial Planned Unit Development as set forth on Exhibit B, be and the same are hereby authorized and approved. SECTION That the approval and authorization of said Amendment TWO: to Special Use of the Subject Property as and for office uses, as more specifically described below and as hereby granted is subject to the conditions that all use, construction and development shall be in accordance with the Final Plan - Phase IV of the Subject Property submitted by Applicant to the Plan Commission, a copy of which is included and marked as Exhibit B and attached hereto and made a part hereof, all other documentary and exhibit filings made pursuant to Planned Unit Development Procedures as set forth in Article 12.9 of the Village Zoning Ordinance, the terms of this Ordinance, and all representations made by the Applicant to the Plan Commission and President and Board of Trustees. SECTION That the Applicant be permitted as a clarification of THREE: the applicable provisions contained in the Annexation Agreement between Applicant and the Village to construct a mechanical override on the building to a maximum height not to exceed 79 feet. SECTION That any violation of any of the conditions hereinabove FOUR: set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Amended Special Use - Phase IV hereby authorized. SECTION That the Village Clerk is hereby directed to publish FIVE: this Ordinance in pamphlet form and to record said Ordinance and Exhibit B in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION That except to the extent specifically amended hereby, SIX: all provisions of Ordinance No. 85 -36 and the Master Development Plan shall remain in full force and effect and all undertakings of the Applicant or its successors, shall remain in full force and effect as if fully restated herein.
