O-89-455623S/75 ORDINANCE NO. 0 -89 -45 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE PLANNED UNIT DEVELOPMENT Published in pamphlet form this 5th day. of September , 1989, by the President and Board of Trustees of Deerfield. 562352071989/73 ORDINANCE NO. 0 -89 -45 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE PLANNED UNIT DEVELOPMENT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of ALLEN SCHMIDT ( "Applicant ") to authorize an amendment to the Final Landscaping Plan in connection with the development and use of certain real estate located at the northwest corner of Franken Avenue and Elm Street and legally described on Exhibit A hereto (the "Subject Property ") as a Special Use Planned Development, under and pursuant to the provisions of Articles 4.5 -3,.8, 12.1, 12.2, 12.9 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, following the consideration of the recommendations of the Plan Commission by the President and Board of Trustees, the President and Board of Trustees have considered and reviewed the submitted Final Landscaping Plan, dated July 1, 1989, and prepared by Hoschl Landscape Co. (the "Final Landscaping Plan "); and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Amendment to Special Use Planned Unit Development in accordance with the Final Landscaping Plan for the Subject Property marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby ONE: affirmatively find that the Amendment to Special Use as hereby authorized, fully complies with the requirements and standards set forth in Articles 4.5 -3, 8, 12.1, 12.2, 12.9 and 13.11 of the Village Zoning Ordinance, and the Amendment to Special Use of the real estate set forth in the Final Landscaping Plan as set forth on Exhibit B subject to certain conditions as more particularly set forth below, be and the same is hereby authorized and approved. SECTION That the approval and authorization of said Amendment TWO: to Special Use Planned Development is hereby granted subject to the requirements that all landscaping shall be (i) in accordance with the Final Landscaping Plan (with the exception that a maple tree of six inch caliper be substituted for the seedless ash located next to the southwest corner of the adjoining property), (ii) all documentary and exhibit filings ORDINANCE NO. 0 -89 -45 AN ORDINANCE AUTHORIZING AN AMENDMENT A SPECIAL USE PLANNED UNIT DEVELOPMENT made pursuant to Planned Unit Development Procedures as set forth in Article 12.9 of the Village Zoning Ordinance, the terms of this Ordinance, all representations submitted and made by the Applicant to the Plan Commission and President and Board of Trustees (including the obligation to construct a seven foot high wood fence at the north, east and west property lines in accordance with the Preliminary Plan dated Februry 13, 1986), and (iii) is also subject to compliance by Applicant with all other applicable provisions of the Zoning Ordinance. SECTION That the Amendment to Special Use hereby authorized THREE: shall be binding upon and inure to the benefit of Applicant's successors, grantees, transferees and assigns and any violation of the conditions hereinabove set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Amendment to Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish FOUR: this Ordinance in pamphlet form and to record said Ordinance and that portion of Exhibit B known as the "Final Landscaping Plan" in the office of the Recorder of Deeds of Lake County, Illinois, at Applicant's expense. SECTION That this Ordinance shall be in full force and effect FIVE: from and after its passage, approval and publication, as provided by law.
