O-89-61603052112789/46 ORDINANCE NO. 0 -89 -61 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 932 HEMLOCK, DEERFIELD, ILLINOIS WHEREAS, MR. JEFF RIEMER has petitioned for a variation from the strict provisions of Article 10.1 -4 of the Zoning Ordinance of the village of Deerfield, passed April 17, 1978, as amended, as applied to the property legally described below which would permit a 4 foot side yard in lieu of the required 5 feet and a combined side yard of 10 feet in lieu of the required 14 feet to accommodate a garage addition; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of ONE: the Zoning Board of Appeals are concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That the Board of Trustees instead finds that there are TWO: practical difficulties and particular hardships in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property, which is legally described as follows: Lot 13 of Clavy's Subdivision of Blocks 1 and 2 of Evergreen Place, a subdivision of the west 660.00 feet of the Southeast Quarter of the Southwest Quarter of Section 29, Township 43 North, Range 12, East of 3rd P.M., Village of Deerfield, Lake County, Illinois, according to the plat thereof recorded August 5, 1926, in Book "Q" of Plats on page 17, as Document No. 284048 in Lake County, Illinois. ORDINANCE NO. 0 -89 -61 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 932 HEMLOCK, DEERFIELD, ILLINOIS SECTION That a variation from the strict provisions of Article THREE: 10.1 -4 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described is hereby granted so as to permit a 4 foot side yard in lieu of the required 5 feet and a combined side yard of 10 feet in lieu of the required 14 feet to accommodate a garage addition. SECTION That the variation hereby granted is subject to FOUR: compliance by the Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and FIVE: effect from and after its passage and approval, as provided by law.
