O-89-63ORDINANCE NO. 0 -89 -63 AN ORDINANCE AMENDING ARTICLE 2 CHAPTER 18 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS.: SECTION That Section 18 -3, entitled "Definitions ", ONE: of Chapter 18 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting Subsection (i) in its entirety and substituting in lieu thereof the following: "(i) Rate card means a card displayed in each taxicab which contains the rates of fare then in force." SECTION That Section 18 -3, entitled "Definitions ", TWO: of Chapter 18 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting Subsection (k) in its entirety and substituting in lieu thereof the following: "(k) Taximeter means a meter instrument or device attached to a taxicab which measures the distance driven and the waiting time upon which the fare is based." SECTION That Section 18 -5, entitled "Application THREE: for certificate; contents." of Chapter 18 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting Subsection (a) in its entirety and substituting in lieu thereof the following: (a) An application for a certificate shall be filed with the Village Manager, and. such application shall be verified under oath and shall furnish the following information: (1) The name and address of the applicant. (2) The financial status of the applicant, including the amounts of all unpaid judgments against the applicant and the nature of the transaction or acts giving rise to said judgments. (3) The experience of the applicant in the transportation of passengers. ORDINANCE NO. 0 -89 -63 AN ORDINANCE AMENDING ARTICLE 2 CHAPTER 18 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD (4) Any facts which the applicant believes tend to prove that public convenience and necessity require granting of a certificate. (5) The number of vehicles to be operated or controlled by the applicant and the location of proposed depots and terminals. (6) The color scheme or insignia to be used to designate the vehicles of the applicant. (7) Such further information as the Manager of the Village may require." SECTION That Section 18 -16, entitled "Inspection FOUR: of vehicles; generally" of Chapter 18 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting said Section 18 -16 in its entirety and substituting in lieu thereof the following: "Sec. 18 -16. Inspection of vehicles; conditions to be maintained. The Chief of Police shall maintain constant vigilance over all taxicabs and see that they are kept in a condition of continued fitness for public use. To this end, the Chief of Police shall inspect or cause to be inspected all taxicabs, from time to time, or on the complaint of any person, or as often as may be necessary. (a) No vehicle shall be operated as a taxicab upon the streets of the Village unless all the conditions in this section are met. (b) A valid municipal or county vehicle license and the Village business license must be permanently affixed to the front of the windshield of the vehicle for which it is issued. (c) All applicable equipment must comply with the provisions of the Illinois Vehicle Code (Illinois Revised Statutes Chapter 95�) including brakes, steering system, all lights, tires, horn, mufflers, all mirrors, windshield wipers, doors, frame and body, all windows and directional signals. (d) The vehicle shall be maintained in a safe operating condition. The interior shall be free from refuse and litter. The seats, floor and upholstery must be clean and undamaged, and the exterior in good - 2 - Q ORDINANCE NO. 0 -89 -63 AN ORDINANCE AMENDING ARTICLE 2 CHAPTER 18 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD condition, free of rust, clean and properly maintained. (e)-Each taxicab shall bear on the exterior of each rear door the name of the taxicab business and the identification number assigned to such vehicle. All lettering shall be painted and be no less than two (2) inches and no greater than five (5) inches in height. (f) No vehicle licensed under the provisions of this Article shall imitate or conflict by business name, color scheme, identifying design, monogram, slogan or insignia with any other vehicle or business so licensed. (g) Taxicabs that have been previously inspected by a recognized municipal licensing facility within ninety (90) days need not be inspected unless the Chief of Police or his designee determines a need to inspect such taxicab." SECTION That Section 18 -17, entitled "Vehicles FIVE: must be kept in a clean and sanitary condition" of Chapter 18 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting said Section 18 -17 in its entirety. SECTION That Section 18 -18, entitled "Designation SIX: of taxicabs" of Chapter 18 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting said Section 18 -18 in its entirety. SECTION That Section SEVEN: required" of Code of the amended, be and the same is h( Subsection (b) in its entirety the following: 18 -19, entitled "Taximeter Chapter 18 of the Municipal Village of Deerfield of 1975, as sreby further amended by deleting and substituting in lieu thereof "(b) Meters shall be sealed at all points and connections which, if manipulated would affect their correct reading and recording. Each taximeter shall have thereon an indicator to denote when the vehicle is employed and when it is not employed; and it shall be the duty of the driver to reset such taximeter into a non - recording position at the termination of - 3 - ORDINANCE NO. 0 -89- 63 AN ORDINANCE AMENDING ARTICLE 2 CHAPTER 18 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD each trip. Each meter shall be calibrated in accordance with a fare rate not exceeding the maximum under this Chapter." SECTION That Section 18 -28, entitled "Qualifications EIGHT: of applicant for driver's license" of Chapter 18 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting Section 18 -28 in its entirety and substituting in lieu thereof the following: "Sec. 18 -28. Qualifications of applicant for driver's license. (a) Each applicant for a driver's license shall: (1) Be at least eighteen (18) years of age. (2) Be in good health with good eyesight and shall have an approved physicians affidavit completed by a licensed physician. (3) Be able to read, write and speak the English language. (4) Possess a valid driver's license. (5) Have no convictions for a felony. (6) Be clean in dress and in person." SECTION That Section 18 -29, entitled "Application NINE: for driver's license." of Chapter 18 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting Subsection (a) in its entirety and substituting in lieu thereof the following: it (a) An application for a taxicab driver's license shall be filed with the Village Manager and such application shall be verified under oath and shall contain the following information: (1) The names and addresses of four (4) reputable persons who have known the applicant for a period of two (2) years and who will vouch for the sobriety, honesty, and general good character of the applicant. (2) The experience of the applicant in the transportation of passengers. == ORDINANCE NO. 0 -89 -63 AN ORDINANCE AMENDING ARTICLE 2 CHAPTER 18 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD (3) The education background of the applicant. (4) A concise history of his employment." SECTION That Section 18 -30, entitled "Examination TEN: of applicant; current State motor vehicle operator's permit required." of Chapter 18 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting Subsection (a) in its entirety and substituting in lieu thereof the following: " (a) Before any application is approved by the Village Manager or his designee, the applicant shall be required to pass an examination as to his knowledge of the Village and of traffic regulations." SECTION That Section 18 -31, entitled "Police ELEVEN: investigation of applicant; traffic and police record" of Chapter 18 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting said Section in its entirety and substituting in lieu thereof the following: "Sec. 18 -31. Police investigation of applicant; traffic and police record. The Police Department shall conduct a traffic and police record investigation of each applicant for a taxicab driver's license." SECTION That Section 18 -32, entitled "Consideration TWELVE: of application by the Board" of Chapter 18 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting said Section in its entirety and substituting in lieu thereof the following: "Sec. 18 -32. Consideration of application by the Village Manager. The Village Manager or his designee shall upon consideration of the application, Police Department investigation and physician's certificate approve or reject the applicant." - 5 - ORDINANCE NO. 0 -89 -63 AN ORDINANCE AMENDING ARTICLE 2 CHAPTER 18 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD SECTION That Section 18 -33, entitled "Issuance of THIRTEEN: license; duration; annual fee" of Chapter 18 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting Subsection (a) in its entirety and substituting in lieu thereof the following: "(a) Upon approval of an application for a taxicab driver's license the applicant shall be issued a license, upon payment of a fee of Five Dollars ($5.00) which shall bear the name, address, age, signature and photograph of the applicant." SECTION That the Village Clerk is FOURTEEN: to publish this Ordinance form. SECTION That this Ordinance shall FIFTEEN: and effect from and after approval and publication, hereby directed in pamphlet be in full force its passage, as provided by law.
