AN ORDINANCE AMENDING THE ZONING
MAP AND AUTHORIZING A SPECIAL USE
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of JACOBS HOMES,
INC. (Applicant) for the classification of certain property
(hereinafter the "Subject Property ") located within the Village in
the R -5 General Residence District and to authorize the development
and use of the Subject Property legally described on Exhibit A
hereto as a Special Use Planned Unit Development, under and pursuant
to the provisions of Articles 4.5 -3, 8, 12.1, 12.2, 12.9 and 13.4
for 16 dewlling units as hereinafter more particularly described on
the Subject Property; and
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was in all respects held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield, after
considering the evidence adduced, made written findings of fact
recommending that the Zoning Map be amended to include the Subject
Property in the R- 5'General Residence District; and
WHEREAS, following consideration of the recommendations of the
Plan Commission and the Preliminary Development Plan by the
President and Board of Trustees, the President and Board of Trustees
have considered and reviewed the submitted Final Development Plan,
dated , 1988, and prepared by Johnston Assoc., Inc. (the
"Final Development Plan "); and
WHEREAS, the President and Board of Trustees of the Village of
Deerfield have determined that the best interests of the Village
will be served by reclassification of the Subject Property as
proposed by the Plan Commission and the authorization and granting
of said Special Use Planned Unit Development in accordance with the
Final Development Plan for the Subject Property marked Exhibit B and
attached hereto and made a part hereof and by the further finding
that the Final Development Plan is in substantial conformance with
the previously approved Preliminary Development Plan.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:

AN ORDINANCE AMENDING THE ZONING
MAP AND AUTHORIZING A SPECIAL USE
SECTION That the Zoning Map of the Village of Deerfield
ONE: be included and made a part of the Village Zoning
Ordinance passed April 17, 1978, as amended, is hereby
further amended by zoning and classifying the property described in
Exhibit "A ", attached hereto and made a part hereof, to the R -5
General Residence District.
SECTION That the President and Board of Trustees do hereby
TWO: affirmatively find (1) that the Special Use as hereby
authorized, fully complies with the requirements and
standards set forth in Articles 4.5 -3, 8, 12.1, 12.2, 12.9 and 13.4
of the Village Zoning Ordinance, and the Special Use of the real
estate, as and for purposes of a Residential Planned Unit
Development as set forth on Exhibit B subject to certain conditions
as more particularly set forth below and (2) that the Final
Development Plan is in substantial conformance with the previously
approved preliminary development plan and that therefore, said
special use shall be and the same, is hereby authorized and approved.
SECTION That the approval and authorization of said Special Use
THREE: Planned Unit Development is hereby granted subject to
the requirements that (i) the Applicant will
contribute an amount not to exceed $125,000 to the Village of
Deerfield to provide certain storm sewer improvements in accordance
with plans and specifications to be submitted to and approved by the
Village Engineer of the Village of Deerfield and (ii) that all use,
construction and development shall be in accordance with, in
addition to the submitted Final Development Plan, all documentary
and exhibit filings made pursuant to Planned UniI Development
Procedures as set forth in Article 12.9 -6 of the Village Zoning
Ordinance, the terms of this Ordinance, all representations
submitted and made by the Applicant to the Plan Commission and
President and Board of Trustees and is also subject to compliance by
Applicant with all other application provisions of the Village
Zoning Ordinance.
SECTION That the Special Use hereby authorized shall be binding
FOUR: upon and inure to the benefit of Applicant's
successors, grantees, transferees and assigns and any
violation of the conditions hereinabove set forth by the Applicant
or its successors, grantees, transferees or assigns shall authorize
the revocation of the Special Use hereby authorized.

SECTION That the Village Clerk is hereby directed to publish
FIVE: this Ordinance in pamphlet form and to record said
Ordinance and that portion of Exhibit B known as the
"Final Development Plan" in the office of the recorder of Deeds of
Lake County, Illinois at Applicant's expense.
SECTION That this Ordinance shall be in full force and effect
SIX: from and after its passage, approval and publication,
as provided by law.
