Doc. # Recorded See: Exhibits File ORDINANCE NO. 0 -88 -54 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR DEERBROOK SHOPPING CENTER WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of NORTHWEST NATIONAL BANK OF CHICAGO, as Trustee under Trust Agreement No. 122 dated April 3, 1968 and Marie Callender's Ventures (hereinafter jointly referred to as "Applicant "), to authorize an amendment to the existing Special Use - Planned Unit Development of Deerbrook Shopping Center to permit construction of a,freestanding restaurant all in accordance with the previously approved Deerbrook expansion plan and Articles 2.0 -3, 2, 5.2 -3, 8, 12.5 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all.respect held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced, the submitted Final Development Plan, prepared by Applicant entitled "Expansion Proposal for Marie Callenders" dated , 1988, and attached hereto as Exhibit B (the "Final Development Plan "), made written findings of fact and recommended that said amendment to the Special Use of said real estate be approved and authorized subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan ONE: Commission as to the submitted Final Development Plan, to permit construction of a free standing restaurant are concurred in and adopted as the findings of the President and Board of Trustees and the amendment to the Special Use of the real estate legally described in Exhibit A attached hereto and made a part hereof to approve the Final Development Plan be and the same is hereby authorized and approved. SECTION That the approval and authorization of said amended TWO: Special Use is hereby given subject to the requirements that all use shall be in accordance with, in addition to the Final Development Plan, all exhibits, testimony, representations submitted and made by the Applicant to the Plan Commission and President and Board of Trustees and is also subject ORDINANCE NO. 0 -88 -54 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR DEERBROOK SHOPPING CENTER to compliance by Applicant with all other applicable provisions of the Zoning Ordinance. SECTION That any violation of the conditions hereinabove set THREE: forth shall authorize the revocation of the amended Special Use hereby authorized. SECTION That all approval and authorization of said amendment FOUR: to Special Use hereby given is subject to the require- ment that this Ordinance shall be recorded in the Office of the Recorder of Deeds of-Cook County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That the Village Clerk is hereby directed to publish FIVE: this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and effect SIX: from and after its passage, approval and publication, as provided by law. EXTEN ON DIVISION • y + AGR$EMENT THE VILLAGE OF DEERFIELD, a municipal corporation in the State of Illinois (hereinafter referred to as "the Village "), and DEERFIELD PARTNERS (hereinafter referred to as "the Owner "), do hereby covenant and agree, one with the other, THAT: WHEREAS, Owner is the owner of the Deerbrook Shopping Center ( "Deerbrook ") developed on certain real property, located in the Village; and WHEREAS, access roads have been established within Deerbrook entirely upon the private property of the Owner; and WHEREAS, the constant assurance of safe and controlled vehicular access to Deerbrook for its customers and employees is desirable for the purpose of providing maximum protection of life and property; and WHEREAS, the Municipal Code of the Village provides the means of establishing and controlling such access through the establishment of speed and traffic control restrictions; NOW, THEREFORE, in consideration of the mutual covenants herein contained, and the reciprocal benefits to the parties, it is agreed as follows: 1. That this Agreement is entered into pursuant to the provisions of Section 11 -209.1 of Chapter 95 -1/2 and Section 1 -1 -7 of Chapter 24, Illinois Revised Statutes, 1987. 2. That the Owner requests and authorizes the Village to establish and maintain traffic control restrictions within Deerbrook at the locations as depicted on the plat attached hereto as Exhibit A and made a part hereof. 3. That the Village agrees upon execution hereof to post the appropriate official stop signs as required pursuant to 922 -164. Exhibit D of the Municipal Code of the Village, which will add the locations depicted on Exhibit A hereto as stop street intersections. 4. That a speed limit of 25 miles per hour shall be established on the roadway depicted on Exhibit A. 5. That said roadway shall be appropriately posted with stop signs and speed limit signs and the Owner shall pay the cost of said signs and the cost of installation and ..maintenance thereof. 6. That the Village shall enforce the speed limit and traffic control restrictions in the areas herein agreed to. 7. That the establishment of said speed limits and - traffic constolsand the enforcement of these restrictions by the Village in no way constitutes a dedication of any of the Owner's real property to public use. 8. That either the Village or the Owner reserve the right to cancel this Agreement at any time. 9.
