O-88-715489S/34 ORDINANCE NO. 0 -88 -71 AN ORDINANCE AMENDING THE ZONING MAP AND AUTHORIZING A SPECIAL USE WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of LaSalle National Bank as Trustee under Trust No. 104882, dated August.17, 1982, LaSalle National Bank as Trustee under Trust No. 106800, dated June 27, 1983, and The Fountains of Deerfield Development Corporation (collectively, "Applicant ") for the classification of certain property (hereinafter the "Subject Property ") located within the Village in the R -5 General Residence District and to authorize the development and use of -the Subject Property legally described on-.- Exhibit A hereto as a Special Use Planned Unit Development, under--­--..---:­-,-::_ and pursuant to the provisions of Articles 4.5 -3; 8,- •12:1, 12.2, 12.9 and 13.4 for 76 dwelling units as hereinafter more particularly described on the. -- Subject Property; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and' WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact recommending that.the Zoning Map be amended to include the Subject Property in the R -5 General.Residence District; and- - WHEREAS, following consideration of the recommendations of the'- - Plan Commission and the Preliminary Development Plan by the President and Board of Trustees, the President and Board of Trustees have considered and reviewed the submitted Final Land Use.Plan and the Final Landscape Plan, each dated October 27, 1988 1988, and prepared by Bloodgood Architects; Inc. and Schreiber /Anderson Associates (collectively, the "Final Development Plan "); and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by reclassification of the Subject Property as proposed by the Plan Commission and the authorization and granting. - of said Special Use Planned Unit Development in accordance with Final Development Plan for the Subject Property marked Exhibit B and-'..._--... attached hereto and made a part hereof and by the further finding that the Final Development Plan is in substantial conformance with the previously approved Preliminary Development Plan. Exhibit "A ", attached hereto and made a part hereof, to the R -5 General Residence District. SECTION. That the President and Board of Trustees do hereby TWO: affirmatively find (1) that the Special Use as hereby.. authorized, fully complies with the requirements and standards set forth in Articles 4.5 -3, 8, 12.1; 12.2, 12.9 and 13.4 of the Village Zoning Ordinance, and the Special Use of the real estate, as and f-or purposes of a Residential Planned Unit.. - Development as set forth =--on Exhibit B subject "to -certain - -conditions as more particularly set forth below and (2) that the Final Development Plan is in substantial. conformance with the previously = - approved preliminary development plan and that therefore, said special use shall be and the same, is hereby authorized and approved._ SECTION That the approval and authorization of said Special Use THREE: Planned Unit Development is hereby granted subject to. the requirements that all use, construction and development shall be in accordance with, in addition to the - submitted Final Development Plan, all documentary and exhibit filings made pursuant to Planned Unit Development Procedures as set forth in Article 12.9 -6 of the Village Zoning Ordinance, the terms of this Ordinance, all, representations submitted and made by the Applicant to the Plan Commission and President and Board of .Trustees_-.-_ and is also subject to compliance by Applicant with all other - application provisions of the Village Zoning Ordinance.
