O-88-30I 4940S/85 ' I ORDINANCE NO. 0 -88 -30 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 119 BIRCHWOOD, DEERFIELD, ILLINOIS WHEREAS, MR. SCOTT GERBERDING has petitioned for a variation from the strict provisions of Article 12, Section 12.3- 7 -2,of the Zoning Ordinance of the Village.of Deerfield, passed April 17, 1978, as amended, as applied to the property legally described below which would permit a 2.3 foot side yard.to accommodate the construction of an addition in lieu of the required 10 feet and a combined side yard of 10.88 feet in lieu of the required 20 feet; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of the ONE: Zoning Board of Appeals'are concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That the Board of Trustees finds that there are TWO: practical difficulties and particular hardships in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property, which is legally described as follows: Lot 3 in Sweeney - Kloepher Resubdivision of Lots 67 and 68 in J.S. Hovland's First Addition to Deerfield in the Southwest Quarter of Section 32, Township 43 North, Range 12, East of the Third Principal Meridian, according to the plat of said resubdivision recorded September 23, 1971 as Document No. 1524897, in Book 49 of Plats, page 74, in Lake County, Illinois. SECTION That a variation from the strict provisions of Article THREE: Article 12, Section 12.3- 7 -2.-of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described is hereby granted so as to permit a 2.3 foot side yard to accommodate the construction of an addition in lieu of the required 10 feet and a combined side yard of 10.88 feet in lieu of the required 20 feet.
