O-88-35a. 0972E1050488 I ORDINANCE NO. 0 -88 -35 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR DEERFIELD COMMONS SHOPPING CENTER Published in pamphlet form this 6th day of i. 1988 by the President.and -Board of Trustees of Deerfield ORDINANCE NO. 0 -88 -35 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR DEERFIELD COMMONS SHOPPING CENTER WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of DEERFIELD COMMONS SHOPPING CENTER ASSOCIATES, BANBURY DEVELOPMENT, INC. and AMERICAN NATIONAL BANK AND TRUST COMPANY OF CHICAGO, as Trustee under Trust Agreement No. 101423 -05 dated February 20, 1987 (collectively, the "Applicant "), to authorize an amendment to the existing Special Use - Planned Unit Development of Deerfield Commons Shopping Center to permit parking lot repairs and reconfiguration and renovation of existing building facades, all in accordance with Articles 2.0 -3, 2, 5.1 -3, 10, 12.6 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced, the submitted Final Development Plan, prepared by the Cawn Group, PC entitled "Proposed Landscaping and Site Redevelopment Plan" dated May 12, 1988, and attached hereto as Exhibit B, which also includes elevations and sign criteria, including a graphic prepared by the Cawn Group, PC depicting the refurbishment of the two (2) existing entrance pylon signs (collectively, the "Final Development Plan "), made written findings of fact and recommended that said amendment to the Special Use of said real estate be approved and authorized subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan ONE: Commission and the Village Center Development Commission as to the submitted Final Development Plan, to permit construction of parking lot repairs and reconfiguration and renovation of existing building facades, are concurred in and adopted as the findings of the President and Board of Trustees and the amendment to the Special Use of the real estate legally described in Exhibit A attached hereto and made a part hereof to approve the Final Development Plan be and the same is hereby authorized and approved. ORDINANCE NO. 0 -88 -35 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR DEERFIELD COMMONS SHOPPING CENTER SECTION That the approval and authorization of said amended TWO: Special Use is hereby given subject to the requirements that all use shall be in accordance with, in addition to the Final Development Plan, all exhibits, testimony, representations submitted and made by the Applicant to the Plan Commission, the Village Center Development Commission, the Appearance Review Commission and President and Board of Trustees and is also subject to compliance by Applicant with the following conditions: 1. Deerfield Commons Shopping Center Associates shall execute and deliver to the Village a Grant of License prepared in recordable form which shall provide in substance as follows: Permission and authority are hereby given and granted to the Village of Deerfield, an Illinois municipal corporation, for the construction, maintenance and use of certain streetscape improvements upon the following portion of the subject property: (i) the five (5) foot strip of property abutting the public right -of -way along Waukegan Road immediately north of that portion of the Frost Building which is currently occupied by Merrill Lynch; and (ii) the five (5) foot strip of property abutting the public right -of -way along Waukegan Road east of the portion of the subject property which is currently occupied by The Belden Deli. Unless otherwise terminated by the mutual agreement of the Village and Deerfield Commons Shopping Center Associates, the permission and authority hereby given and granted to the Village of Deerfield shall continue in effect for an initial period of twenty (20) years and shall thereafter be renewable for successive ten (10) year periods unless the Village shall notify the Applicant to the contrary not less than thirty (30) days prior to the expiration of said term or any renewal thereof; provided, however, that construction of the aforesaid streetscape improvements has been substantially completed within five (5) years after ORDINANCE NO. 0 -88- 35 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR DEERFIELD COMMONS SHOPPING CENTER the date of the adoption of this Ordinance. The Applicant shall take no action to interfere with or impair the Village's right, permission or authority as provided for herein. The License hereby granted and as it may be renewed from time to time, shall be binding upon the Applicant's successors, assigns and grantees. 2. The Applicant shall contribute the sum of $15,000_in.... cash, letter of credit or other form of depsoit acceptable to the Village for the purpose of the construction, maintenance and use of the foresaid streetscape improvements, said sum to be held by the Village in escrow for such stated purpose, provided that said sum shall be returned to the Applicant if construction of the streetscape improvements is not substantially completed within five (5) years after the date of the adoption of this Ordinance. 3. The westerly five (5) feet of the ten (10) foot strip of. property abutting the public right -of -way along Waukegan Road immediately north of that portion of the Frost Building which is currently occupied by Merrill Lynch shall be maintained by the Applicant at its own expense for landscape screening in a curb planting area. 4. The two (2) existing entrance pylon signs to the Subject Property shall be refurbished in accordance with Exhibit B as part of the Final Development Plan attached to and made part of this Special Use Ordinance. 5. No parking may occur within the area designated on the site plan as fire lane. 6. Compliance with all other applicable provisions of the Zoning Ordinance, and all other ordinances, codes and regulations of the Village of Deerfield. SECTION That any violation of the conditions hereinabove set THREE: forth shall authorize the revocation of the amended Special Use hereby authorized. ORDINANCE NO. 0 -88 -35 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR DEERFIELD COMMONS SHOPPING CENTER SECTION That all approval and authorization of said amendment FOUR: to Special Use hereby given is subject to the require- ment that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That the Village Clerk is hereby directed to publish FIVE: this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and effect SIX: from and after its passage, approval and publication, as provided by law. Lnicago,ininois The Cawn Group,P.C. / Northbrook,lllinois MAY 12.1988 4 EXHIBIT E SIGN CRITERIA Z-All;Z.1-49 -211 7;;1/1� This criteria for signs is intended to provide a means of controlling tenant signage on the main retail building, by setting standards for sign type, letter type, colors,i locations and the understanding of a merchant's need for exposure. This criteria shall apply to all tenant signs for the main retail buildings at DEERFIELD COMMONS. Signs for the main retail buildings are intended to provide an overall uniform appearance while allowing. a controlled range of flexibility for tenants' individual interests and needs. Each tenant will have the opportunity to incorporate a logo with the signage if it is part of their identification. The logo, however, must comply with the same criteria as the sign. All signs shall be- erected in conformance with the following requirements: SIGN TYPE: Signs shall consist of individual letters, in all upper case letters, all lower case letters or an upper case first letter and lower case remaining letters, in any letter style, except script type style. SIGN COLOR: Signs shall be allowed in any one of the following colors. Colors shall be Rohm and ilaas Plexiglass or equal. All tenant signs /logo shall be single and shall be mounted such that the center line of the sign /logo shall correspond to the center line of the canopy on which the sign is located. n MOUNTING CONSTRUCTION: All signs shall be erected in the vert cal plane on all canopies. All letters and /or logos shall be connected to the canopy individually. No exposed con- tinuous letter support shall be allowed. NUMBER & TYPE OF SIGNS: Each tenant shall be allowed one major identification sign to be mounted on front facade of canopy. Each tenant shall be allowed one logo, if required, to be mounted on front facade of canopy. If a tenant requires additional signage on the front facade of the canopy to describe the nature of their business, type of goods sold, etc., said signage shall be limited to a one word description and shall be allowed, provided it complies with the sign letter size and color requirements previously stated herein and is contained within the square footage limitations per tenant as indicated.
