AN ORDINANCE AUTHORIZING AN AMENDMENT TO
SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of American
National Bank and Trust Company as Trustee of Trust No. 65708 dated
October 4, 1985 (the "Owner ") and LP Equity Associates Limited and
Deerfield Saunders Joint Venture (collectively, the "Developer ")
(the Owner and Developer herein jointly referred to as "Applicant ")
to authorize an Amendment to Ordinance No. 85 -36 to provide for the
development and use of certain real estate commonly known as "Phase
III" and legally described On Exhibit A hereto for a Special Use -
Planned Unit Development, under and pursuant to the provisions of
Articles 6.1 -3, 5, 12.1, 12.8 and 13.11 of the Zoning Ordinance of
the Village of Deerfield; and
WHEREAS, said hearing was held pursuant to duly published
notice thereof and was in all respects held according to law; and
WHEREAS, following consideration of the recommendations of the
Plan Commission, the President and Board of Trustees have
considered and reviewed the Amended Final Development Plan for the
Subject Property consisting of a master site plan for Parkway North
and building elevations prepared by Hammond, Beeby and Babka dated
February 8, 1988. Landscape plan for Phase III prepared by
Johnson, Johnson & Roy, Inc. dated 4/12/88 and submitted by
Applicant to the Plan Commission collectively the "Final
Development Plan" reflecting all revisions from that portion of the
original Final Development Plan relating to Phase III and in
addition the Plan Commission has considered the proposed
resubdivision of the Subject Property included in Phase III; and
WHEREAS, the President and Board of Trustees of the Village of
Deerfield have determined that the best interests of the Village
will be served by the authorization and granting of said Amendment
to Special Use - Industrial Planned Unit Development and that the
approval of the Plat of Resubdivision is in accordance with the
Final Development Plan for the Subject Property marked Exhibit B
and attached hereto and made a part hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the President and Board of Trustees do hereby
ONE affirmatively find the Amended Special Use, as
hereby authorized, fully complies with the
requirements and standards set forth in Articles 12.11 -4 of the
Village Zoning Ordinance, and Amended Special Use of the real
estate, as and for purposes of an Industrial Planned Unit
Development - Phase II as set forth on Exhibit B, and the Plat of
Resubdivision including said property, be and the same is, hereby
authorized and approved.

AN ORDINANCE AUTHORIZING AN AMENDMENT TO
SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT
SECTION That the approval and authorization of said Amendment
TWO: to Special Use of the Subject Property as and for
Phase III as more specifically described below and
as hereby granted is subject to the following conditions:
(a) That all use, construction and development shall
be in accordance with the Final Development Plan of the
Subject Property submitted by Applicant to the Plan
Commission, a copy of each of which is included and marked
as Exhibit B and attached hereto and made a part hereof,
all other documentary and exhibit filings made pursuant to
Planned Unit Development Procedures as set forth in Article.
12.9 of the Village Zoning Ordinance, the terms of this
Ordinance, and all representations made by the Applicant to
the Plan Commission and President and Board of Trustees.
(b) That the striping of the garage parking lot be
altered to increase the width of each parking space to 8
feet.
SECTION That any violation of any of the conditions hereinabove
THREE: set forth by the Applicant or its successors, grantees,
transferees or assigns shall authorize the revocation
of the Amended Special Use hereby authorized.
SECTION That the Village Clerk is hereby directed to publish
FOUR: this Ordinance in pamphlet form and to record said
Ordinance, Exhibit B and the Plat of Resubdivision in
the office of the Recorder of Deeds of Lake County, Illinois at
Applicant's expense.
SECTION That except to the extent specifically amended hereby,
FIVE: all provisions of Ordinance No. 85 -36 shall remain in
full force and effect and all undertakings of the
Applicant or its successors, shall remain in full force and effect
as if fully restated herein.

SECTION That this Ordinance shall be in full force and effect

as provided by law.
