Doc. # 59 33��`� Recorded See: Exhibits He 2733284 0972E,28 1 1 ORDINANCE NO. 0 -88 -45 AN ORDINANCE AUTHORIZING AN AMENDMENT TO THE ZONING MAP AND AN AMENDMENT TO SPECIAL USE FOR MORIAH CONGREGATION WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Moriah Congregation ( "Applicant ") to (i) amend the Zoning Map of the Village of Deerfield to reclassify the Subject Property legally described on Exhibit A hereto and made a part hereof, from the P -1, Public Lands District to the R -2 Single Family Residence District; (ii) to expand the area of the building by constructing an addition to the existing structure and (iii) to expand the present parking area on the property pursuant to the provisions of Articles 4.2 -3, 4, 13.4 -2,1 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced, including a Site Plan (the "Final Plan ") prepared by Phillip Kupritz & Associates, dated June 29, 1988, and attached hereto and made a part hereof as Exhibit B made written findings of fact and recommended that said reclassification of the Subject Property to the R -2 Single Family Residence District and amendment to the Special Use of said real estate be approved and authorized as to the expansion of the building and the expansion of the parking area subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES.OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan ONE: Commission both as to the reclassification of the Subject Property in the R -2 Single Family Residence District, and the expansion of the building and the parking lot are concurred in and adopted as the findings of the President and Board of Trustees, and, therefore, the reclassification of the Subject Property in the R -2 Single Family Residence District and the Amendment to Special Use of the real estate legally described in Exhibit.A attached hereto and made a part hereof, for an expansion of the floor area of the building and the parking lot all to be constructed on the Applicant's property, be and the same are hereby authorized and approved. PR %' ORDINANCE NO. 0 -88 -45 AN ORDINANCE AUTHORIZING AN AMENDMENT TO THE ZONING MAP AND AN AMENDMENT TO SPECIAL USE FOR MORIAH CONGREGATION SECTION That the approval and authorization of said Amendment TWO: to Special Use is hereby given subject to the require- ments that all use shall be in accordance with all documents and representations submitted and made by Applicant to the Plan Commission, and President and Board of Trustees specifically including the Final Plan attached as Exhibit B and is also subject to compliance by Applicant with all other applicable provisions of the Zoning Ordinance with the exception that the requirement of curbing and wheel stops in the parking area are hereby waived. SECTION That all approval and authorization of said Amendment THREE: to Special Use hereby given is subject to the require- ment that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That the Village Clerk is hereby directed to publish FOUR: this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and effect FIVE: from and after its passage, approval and publication, as provided by law.
