O-88-1449405/56 ORDINANCE NO. 0 -88 -14 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE- INDUSTRIAL PLANNED UNIT DEVELOPMENT AND VARIATIONS FROM ARTICLE 12 Published.in pamphlet form this 2lstday of March , 1988 by the President and Board of Trustees of Deerfield ORDINANCE NO. 0 -88 -14 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT AND VARIATIONS FROM ARTICLE 12 WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Matas Corporation and The Residence Inn Company (collectively, the "Developer ") and American National Bank and Trust Company of Chicago as Trustee under Trust Agreement dated August 31, 1983 and known as Trust No. 59087 and American National Bank and Trust Company of Chicago as Trustee under Trust Agreement dated August 31, 1983 and known as Trust No. 65110 (collectively, the "Owner ") to authorize an amendment to Special Use, Ordinance 084 -63, to provide for the development and use of a portion of that certain real estate described on Exhibit A hereto (the "Subject Property ") as a Special Use Industrial Planned Unit Development under and pursuant to the provisions of Articles 6.1 -3,5, 12.1, 12.8, 12.9 and 13.11 of the Zoning Ordinance of the Village of Deerfield which such development shall include an extended stay lodging facility, a certain "Off -Site" sign to be located at the Lake- Cook*Road entrance to the Subject Property, and related uses as hereinafter more particularly described and to authorize the approval of certain variations from the strict provision of Article 12.8 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, to permit variations from the perimeter setback requirements of Article 12.8; and WHEREAS, the Developer and the Owner are hereinafter collectively referred to as the "Applicant "; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission and of a certain preliminary development plan presented to and approved by the President and Board of Trustees of the Village of Deerfield on September 21, 1987, the President and Board of Trustees have considered and reviewed the submitted Final Site Plan -Hotel Parcel, dated January 6, 1988, as revised, prepared by Howard & Helmer Architects, P.A. ( "Final Site Plan "), the Final Landscape Plan -Hotel Parcel, dated November 17, 1987, prepared by Howard & Helmer Architects, P.A., the Signage Information plan (sheets 1 and 2, dated January 6, 1988; sheet 3 revised February 10, 1988), prepared by Howard & Helmer Architects, P.A. (sheets l,'2, and 3), and the Monument Sign plan, dated March 2, 1988, prepared by Tencon, Inc. (the aforesaid final plans are collectively hereinafter referred to as the "Final Development Plan -Hotel Parcel" and are attached hereto and made a part hereof as Exhibit B); and ORDINANCE NO. 0 -88 -14 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT AND VARIATIONS FROM ARTICLE 12 . WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and grant.ing of said Amendment to Special Use - Industrial Planned Unit Development, Ordinance 084 -63, and of said variations; . NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby ONE: affirmatively find the Amendment to Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 6.1 -3,5, 12.1, 12.8, 12.9 and 13.11 of the Zoning Ordinance, and the Amendment to Special Use of the Subject Property, as and for purposes of an Industrial Planned Unit Development to permit the development of an extended stay lodging facility, a certain "Off- Site" sign to be located at the Lake -Cook Road entrance to the Subject Property and. related uses as herein described on the Subject Property, all in accordance with Exhibit B, and further find that the variations from the strict provision of Articles 12.8, as more particularly set forth below, are hereby authorized and approved to permit variations from the perimeter setback requirements of Article 12.8. SECTION That the approval and authorization of said Amendment TWO: to Special Use and the said variations as hereby granted is subject to the following conditions: (A) That all use, construction and development shall be in accordance with the Final Development Plan -Hotel Parcel and with all other documentary and exhibit filings made pursuant to Planned Unit Development Procedures as set forth in Article 12.9 -6 of the Village Zoning Ordinance, the terms of this Ordinance, and all exhibits, testimony and representations submitted and made by the Applicant to the Plan Commission and to the Village President and Board of Trustees. . (B) That the use of the hotel parcel located on the Subject Property and depicted on the Final Development Plan - Hotel Parcel shall be for k � 1 ORDINANCE NO. 0 -88 -14 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT AND VARIATIONS FROM ARTICLE 12 Extended Stay Lodging Facilities and accessory uses, in accordance with the Final Development Plan -Hotel Parcel. SECTION That the President and Board of Trustees do hereby THREE: grant and authorize certain variations from the strict provision of Article 12.8 to permit parking within the perimeter setbacks, and to not require landscaping in such setbacks; however, the perimeter setbacks shall be developed in accordance with the Final Development Plan -Hotel Parcel. SECTION That the Amendment to Special Use, Ordinance 084 -63, FOUR: and the said variations hereby authorized shall be binding upon and inure to the benefit of Applicant's successors, grantees, transferees, and assigns and any violation of the conditions hereinabove set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the amendment to Special Use and the variations hereby authorized. SECTION That the Village Clerk is hereby directed to publish FIVE: this Ordinance . in pamphlet form and to record said Ordinance and the Final Site Plan in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION That this Ordinance shall be in full force and effect SIX: from and after its passage, approval and publication, as provided by law.
