O-88-17a 49405/63 ORDINANCE NO. 0 -88 -17 AN ORDINANCE AUTHORIZING A SPECIAL USE PLANNED UNIT DEVELOPMENT Published in pamphlet form this 4th day of April , 1988 by the President and Board of Trustees of Deerfield Doc. -7 Q 1, 701 Recorded g�0 See: Exhibits File :/ a, ORDINANCE NO. 0 -88 -J7 AN ORDINANCE AUTHORIZING A SPECIAL USE PLANNED UNIT DEVELOPMENT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Deerfield Residents Partnership, an Illinois general partnership (Developer) and LaSalle National Bank, not individually, but as Trustee under Trust Agreement dated August 18, 1987, and known as Trust No. 112571, (Owner) (herein Owner and Developer are collectively referred to as "Applicant ") to authorize the development and use of certain real estate located at the northwest corner of Franken Avenue and Elm Street and legally described on Exhibit A hereto (the "Subject Property ") as a Special Use Planned Unit Development, under and pursuant to the provisions of Articles 4.5 -3, 8, 12.1, 12.2, 12.9 and 1311 for 14 duplex dwelling units as hereinafter more particularly described on the Subject Property; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and . WHEREAS, following consideration of the recommendations of the Plan Commission and the Preliminary Development Plan by the President and Board of Trustees, the President and Board of Trustees have considered and reviewed the submitted Final Development Plan, dated January 26, 1988, and prepared by Rolf C. Campbell and Associates Inc., landscape architect and landplanner, and William Horne, architect (the "Final Development Plan "); and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Special Use Planned Unit Development in accordance with the Final Development Plan for the Subject Property marked Exhibit B and attached hereto and made a part hereof and by the further finding that the Final Development Plan is in substantial conformance with the previously approved Preliminary Development Plan. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby ONE: affirmatively find (1) that the Special Use as hereby authorized, fully complies with the requirements and standards set forth in Articles 4.5 -3, 8, 12.1, 12.2, 12.9 and 13.11. of the Village Zoning Ordinance, and the Special Use of the real estate, as and for purposes of a Residential Planned Unit Development as set forth on Exhibit B subject to certain conditions as more particularly set forth below and (2) that the Final Development Plan is in substantial conformance with the previously approved preliminary development plan, be and the same, are hereby authorized and approved. R � ORDINANCE NO. 0 -88 -17 AN ORDINANCE AUTHORIZING A SPECIAL USE PLANNED UNIT DEVELOPMENT SECTION That the approval and authorization of said Special Use TWO: Planned Unit Development is hereby granted subject to .the requirements that all use, construction and development shall be in accordance with, in addition to the submitted Final Development Plan, all documentary and exhibit filings made pursuant to Planned Unit Development Procedures as set forth in Article 12.9 -6 of the Village Zoning Ordinance, the terms of this Ordinance, all representations submitted and made by the Applicant to the Plan Commission and President and Board of Trustees and is also subject to compliance by Applicant with all other application provisions of the Village Zoning Ordinance SECTION That the Special Use hereby authorized shall be binding THREE: upon and inure to the benefit of Applicant's . successors, grantees, transferees and assigns and any violation of the conditions hereinabove set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish FOUR: this Ordinance in pamphlet form and to record said Ordinance and that portion of Exhibit B known as the "Final Development Plan" in the office of the recorder of Deeds of Lake County, Illinois at Applicant s expense.
