O-88-03ORDINANCE NO. 0 -88 -03 AN ORDINANCE APPROVING A SPECIAL USE IN P -1 PUBLIC LANDS DISTRICT - TRAIL TREE PARK Published in pamphlet form this 18th day of January 1988, by the President and Board of Trustees of Deerfield. 4940S/4 ' I ORDINANCE NO. 0 -88 -03 AN ORDINANCE APPROVING A SPECIAL USE IN P -1 PUBLIC LANDS DISTRICT— TRAIL TREE PARK WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Village of Deerfield Park District (herein referred to as "Applicant ") to authorize the development and use of certain real estate described on Exhibit A attached hereto and known as Trail Tree Park and zoned in the P -1 Public Lands District ( "Subject Property "), for a Special Use to permit the approval of the Comprehensive Master Plan for Park Redevelopment in accordance with the applicable provisions of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant t'o duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission has recommended approval of said application; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Special Use in accordance with the plans and exhibits prepared by Michael P. Tarnow Associates, Inc. Landscape Architects, dated November 4, 1987 and presented by Applicant and marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby ONE: affirmatively find that the Special Use, as hereby authorized, fully complies with the requirements and standards set forth in the applicable provisions of the Village Zoning Ordinance, and the Special Use of the real estate, as and for park purposes as set forth on Exhibit B, prepared by Michael P. Tarnow Associates, Inc. Landscape Architects, dated November 4, 1987, be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of the Special Use TWO: hereby granted is subject to the following conditions: 1. That all use, construction and development of the Subject Property shall be in accordance with a certain Comprehensive Master Plan, prepared by Michael P. Tarnow Associates, Inc. Landscape Architects, dated November 4, 1987, and submitted by Applicant, marked Exhibit B attached ORDINANCE NO. 0 -88 -03 AN ORDINANCE APPROVING A SPECIAL USE IN P -1 PUBLIC LANDS DISTRICT - TRAIL TREE PARK hereto and made a part hereof, all other documentary and exhibit filings made pursuant to the Special Use provisions of the Village Zoning Ordinance, the terms of this Ordinance, and all representations by the Applicant to the Plan Commission and President and Board of Trustees. 2. Applicant shall be granted a variation of the front yard setback reuirement as depicted on Exhibit B to permit the development as proposed. SECTION That any violation of any of the conditions hereinabove THREE: set forth shall authorize the revocation of the Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish FOUR: this Ordinance in pamphlet form and see to its record- ation in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION That this Ordinance shall be in full force and effect FIVE: from and after its passage, approval and publication, as provided by law.
